Civil & Envirmunental Engineers Memorandum March 26, 2002 TO: Board of Directors, and Ed'iaylor,District Water Superintendent FROM: Keith Knibb,Consulting Engineer SUBJECT: Falcon point Booster Pump Station-CEQA As of March 14, 2002, the California Environmental Quality Act(CEQA)review period is closed for the falcon Point Booster Pump Station negative declaration. The Board of Directors held a Public Hearing on March 6,2002_ The District received one written continent letter during the review period and no oral comments at the public bearing. The final CEQA documents included with this report are: Comments and Responses Final Negative Declaration r Notice of Determination Department of Fish and Crame Certificate of Fee Exemption RECOMMENDATIONS T recommend the Board of Directors take the following actions: Adopt the Final Negative Declaration. Approve the project for purposes of CEQA. Authorize the filing of the Notice of Determination with the Office of the Nevada County Clerk and the Governor's Office of Planning and Research. r Adopt the De Minimis Impact Finding and authorize the filing of the Certificate of Fee Exemption with the Nevada County Clerk. One comment letter was received during the review period. A copy of the comment letter is attached. Letter from California Regional Water Quality Control Board, Lahontan Region, March 5, 2002: Comment: Public comment period is not over until March 14,2002. The Dish et should wait until the comment period is over before considering adoption of the Negative Declaration. Response: Comment acknowledged. The District wi it not consider any action regarding adoption of the Negative Declaration until after the close of the public comment period. Comment Regional Board staff disagrees that there are no potentially significant effects associated with the project and disagree that no mitigation measures are needed for the project. The project includes the addition of impervious surfaces that will potentially reduce absorption rates and increase storm water runoff, surface water peak flows,and erosive capacities unless mitigated with storm water controls and best management practices. Project plans should incorporate details regarding temporary and permanent BMPs. Identify where staging areas,material stockpiles, and temporary waste stockpiles will be located. Response: Comment acknowledged. As is the case with all District construction projects of this type, the project will include BMPs to avoid the potential impacts listed in the comment letter. These provisions will be included in the project plans and technical specifications. Technical specifications also include the Guidelines For Erosion Control, prepared by Lahontan Regional Water Quality Control Board which describe the types of erosion protection expected of the Contractor. Because these provisions are standard in District contract documents, they were not included as mitigation measures in the proposed Negative Declaration. However, for the sake of clarification,the following mitigation measures are added-. M-L Temporary BMPs will be incorporated into the project design to be implemented before and during construction. BMPs include construction of hay hale dike or silt fence where necessary to prevent discharge of sediment-laden stormwater in the event of rainfall during construction, covering temporary spoils piles to protect from rainfall,and removal of spoils material to permanent locations protected from offsite migration. M-2. Permanent BMPs will be incorporated into the project design to be implemented during and after construction. BMPs will cl don parking revegetation of exposed soil areas, compacted aggregateP g area, repaving existing paved areas, and permanent disposal of surplus aerr!az excavated material at an acceptable location protected from offsite migration. Comment: Regional Buard staff require that runoff from impervious surfaces be retained on site and treated incorporating Best Available Technology. Describe all aspects of the storm water management system. Regional Board staff consider the proposed infiltration trench by itself to be inadequate in treating vehicular fluids and sand from the parking area. Responses: As described in the Initial Study,the amount of impervious surface created by the project included 400 square feet of building roof and 500 square feel of paved parking area, enough for one service vehicle. Runoff from the building will not contain any potential pollutants requiring treatment,and therefore,detention of the design storm runoff from the building roof in an on-site infiltration trench should be sufficient. Because of concerns regarding the potential for pollutant discharge,treatment requirements,and ongoing maintenance issues associated with the paved parking area, paving is being eliminated from the ,project. The parking area will instead include a compacted gravel surface which will protect the area from erosion without creating any impervious surface. Comment: Documentation should include the total amount of soil disturbance occumng as a result of the project. The Regional Board requires the filing of a.Report of Waste Discharge. The environmental document should address how the project site will be re- stabilized. Response:Comment acknowledged_ The project will involve approximately 4,000 square feet(0,09 acre) of soil disturbance including the pump station,parking area, pipelines, and underground electric facilities. The initial study identified the California Regional.water Quality Control Board,Lahunian Region(far Report of Waste Discharge) as an agency whose approval will be required as a part of this project. The application to the Regional Board will include project plans and specifications detailing project site re- stabilization. This will include re-vegetation of disturbed soil areas, compacted gravel over the parking area, and re-paving existing paved areas such as trenching across Falcon Point Place. Regional Board staff understand that the proposed project consists of constructing a new booster pump station. The new pump station will consist of a 400 square foot building and installation of 570 feet of pipeline and 500 feet of underground electrical facilities. The project also includes the addition of a 500 square foot paved parking area. The project site is located in the Tahoe Donner subdivision of the Town of Truckee. Water quality control standards for the Truckee River Hydrologic Unit contained in the Yt ater Quality Control Plan for the Lahontan Region(Basin Plan)are applicable to this project. We have reviewed all information submitted associated with water quality and beneficial uses of the Truckee River Hydrologic Unit and have the following questions and/or comments: 1. According to the State Clearinghouse,the public comment period for this project is not over until March 14, 2002. Regional Board staff strongly encourage that the Board of Directors for the Truckee Donner Public Utility District(TDPUD) wait until the California Environmental Quality Act(CEQA)public comment period is over before considering adoption of this Negative Declaration (Neg Dec). This will ensure that all public comments have been adequately considered before a decision on adoption is made. 2. Regional Board staff based upon the information provided, disagree with your determination that there are no potentially significant effects associated with this project. Therefore, we also disagree that there are no mitigation measures needed for this project. Please include the following recommendations in the final CEQA document: a.. Issue numbers IV a, c and d of the Environmental initial Study should be listed as "Potentially Significant Impacts Unless Mitigated". Regional Board staff request that the project proponent incorporate details into the project plans regarding the use of temporary and permanent best management practices (BMPs) to prevent possible discharges of pollutants from the site during and aver construction activities to eliminate possible impacts to water quality. This may include minimizing disturbed areas,stabilizing disturbed areas,protecting slopes and channels, controlling internal erosion, opening and closing one section of trench at a time, and temporary and/or permanent storruwater treatment facilities. Before adoption,the environmental document should list the BMPs that will be used to prevent sediment migration off of the project site during construction. The document should also include the BMPs that will be used for permanent stabilization of the site. a Please identify within the Neg Dec and on project plans where staging areas,material stockpiles,and temporary waste material stockpiles, will be located. 3. Regional Board staff require that the runoff from impervious surfaces generated by a 20-year, I- hour storm be retained on site and treated, incorporating Best Available Technology(BAT)to reduce constituent levels to the maximum extent practical. The environmental document shall describe all aspects of the stormwater management system, which may include drop inlets,sand and oil separators,detention basins,filtration devices,etc, and how flow will be directed to these facilities. Please be aware that we will require any existing impervious surfaces that do not have storm water controls to be retrofitted for the 20-year, 1-hour storm. Please address how storm water facilities will be maintained to ensure fimctionality of the system over time. Calculations used to determine sizing and capacity of stormwater treatment and detention facilities(for existing and proposed impervious sufaces) should be included in this Neg Dec in order for Regional Board staff to determine if the project site has adequate space to mitigate potential increases to surface runoff. a. It appears that the project is proposing an infiltration trench. Regional Board staff consider this BMP by itself to be inadequate in treating vehicular fluids and sand from the parking area_ Parking areas are a source of petroleum hydrocarbons and other vehicular fluids that will be mobilized by storm water tunof£ Runoff may also contain sand, salt and other deicing chemicals used on roads and parking lots during winter. Road abrasives may be tracked into the parking areas and mobilized by storm water runoff. Storm water runoff from parking areas shall be treated prior to disposal. The pollutant removal capabilities of the proposed sandloil separator(s)should be detailed in the Neg Dec and on project plans and demonstrate that surface and ground water quality will not be adversely impacted. 41 Future documentation should include the total amount of soil disturbance occurring as a result of this project. The Regional Board requires that dischargers file a Report of Waste Discharge (RWD) when any waste is proposed to be discharged to land or surface waters. The RWD Form 200 is available on-line at xN wev swrcb ^a oovlrwocb6. Once a RWD is filed the Regional Board may issue a waiver or may adopt Waste Discharge Requirements(WDRs) for the discharge. The environmental document should also address how the project site will be re-stabilized so that sediment loading to surface waters is not increased as a result of the proposed project.
