Subject: Purchase of Prosser Heights well site
The Prosser Heights well is located on Alder Drive in Prosser Heights. It has been there
for decades, ever since the subdivision was developed. We recently learned that we
never acquired the easement for the well. We also learned that the owner of the parcel
has not paid his taxes and the property is being sold by Nevada County under a tax
default procedure.
We have communicated our desire to acquire the parcel. Nevada County will sell us the
parcel if we pay the back taxes, which amount to approximately $3,000. Nevada County
is asking for the Board to adopt a resolution authorizing purchase of the land. They are
also asking that we submit the attached application, agreement and letter, along with the
resolution, to complete the package.
RECOMMENDATION: I recommend that the Board adopt the resolution Declaring the
District's Intention to Purchase a Tax-Defaulted Parcel of Real Property From the County
of Nevada and approve submission of the necessary documents for acquisition of the
parcel on land on which sits the Prosser Heights well.

DECLARING THE DISTRICT'S INTENTION TO PURCHASE
A TAX-DEFAULTED PARCEL OF REAL PROPERTY
FROM THE COUNTY OF NEVADA
WHEREAS, the Truckee Donner Public Utility District (the "District") owns and operates a well and pump
station which is situated on a parcel of land in the Prosser Heights neighborhood of Truckee, which parcel is
known as Nevada County APN 19-220-23-000 (the"Property"); and
WHEREAS, the District constructed the well and pump station based upon the understanding that the Property
was owned by the District, and
WHEREAS, the District has recently learned that the Property is not owned by the District, and is set to be
sold by the County of Nevada in a tax-default sale; and
WHEREAS, the County of Nevada has offered to sell the Property to the District for the sum of Three
Thousand Dollars ($3,000), and
WHEREAS, the acquisition of the Property will serve a public purpose of the District in that it will prevent uses
being made of the Property which could damage the District's well and pump station, necessitate its
relocation, or otherwise conflict with the well and pump station;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors adopts the above recitals as its findings,
and
BE IT FURTHER RESOLVED by the Board of Directors that for the reasons set forth above, the Board of
Directors of the Truckee Donner Public Utility District hereby approves the purchase by the District of the
parcel of real property known as Nevada County APN 19-220-23-000 for the sum of Three Thousand Dollars
($3,000).

3rd day of April, 2002 by the following roll call vote:

referenced parcel be sold to Truckee Donner Public Utility District for the amount of
three thousand dollars ($3,000). Attached is TDPUD's Board Resolution No. 2002-95
authorizing the purchase of the property.

AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY
This Agreement is made this day of 44z">I V4'6ol, by and between
the Board of Supervisors of tL,,V0`9 / County,

("PURCHASER"), pursuant to the provisions of Division 1, Part 6, Chapter 8, of the Revenue
and Taxation Code.
The real property situated within said county, hereinafter set forth and described in this
agreement is tax-defaulted and is subject to the power of sale by the tax collector of said
county for the nonpayment of taxes, pursuant to provisions of law.
TERMS AND CONDITIONS
It is mutually agreed as follows:
1. That as provided by Revenue and Taxation Code §3800, the cost of giving notice of
this agreement shall be paid by the PURCHASER, and
2. That the PURCHASER agrees to pay the sum of$ 3,000.00 for the real property
described in Exhibit "A" within 30 days after the date this agreement becor es
effective. Upon payment of said sum to the tax collector, the tax collector shall execute
and deliver a deed conveying title to said property to PURCHASER.
If all or any portion of any individual parcel listed in Exhibit "A" is redeemed prior to the
effective date of this agreement, this agreement shall be null and void as to that individual
parcel. This agreement shall also become null and void and the right of redemption restored
upon the PURCHASER'S failure to comply with the terms and conditions of this agreement.
