HomeMy WebLinkAbout7 Hansel Surplus land Agenda Item # PublicUCKEE DO!:��N�R ' Memorandum To: Board of Dirctors From: Peter Holzmeister Date: April 16, 2002 Subject: Sale of surplus land at Hansel You will probably recall that the Board recently declared certain District-owned parcels surplus. If we are still of the opinion that the parcel should be sold I suggest we now go to the next step in the process. The process set forth in the law, as described to me by Steve Gross, requires that we send a written offer to sell or lease the parcel to the following public entities. The offer needs to be sent by first class mail and must include the location and a description of the property: 1. Town of Truckee— offer to sell or lease for purpose of developing low- and moderate-income housing 2. Truckee Donner Recreation & Park District—offer to sell or lease for park and recreation purposes or open-space purposes 3. State Resources Agency — offer to sell or lease for park and recreation purposes or open-space purposes 4. Tahoe Truckee Unified School District-for school facilities construction or use by a school district for open-space purposes Following is a sample letter, drafted by Steve Gross, for our use: Sample letter: The Truckee Donner Public Utility District hereby offers to sell or lease the property located at[location and description of the property]to the[name of agency]in accordance with California Government Code Section 54222. if your agency desires to purchase or lease the property, please notify the Truckee Donner Public Utility District in writing within 60 days after receipt of this notification. if your agency does not notify TDPUD of its desire to purchase or lease the property, the property may be sold or leased to another agency or person. if you have notified TDPUD of your desire to purchase or lease the property, the TDPUD will enter into good faith negotiations with your agency, and any other agency expressing its desire to purchase or lease the property as required by Section 54222, to determine a mutually satisfactory sales price or lease terms. If the price or terms cannot be agreed upon after a good faith negotiation period of not less than 60 days, the property may be disposed of to another person or agency. Holzmeister RECOMMENDATION: I recommend that the Board authorize the General Manager to to offer the surplus District-owned land on Hansel to the above referenced public agencies.
