SUBJECT: LAFCO ANNEXATION' APPLICATION, SPHERE OF INFLUENCE UPDATE,
AND MASTER SERVICES ELEMENT UPDATE
We have completed the Annexation Application for the Glenshire Mutual Water Company
service territory. We have also completed the Sphere of Influence update, including updated
Master Services Element, reflecting the recent acquisition of the Glenshire and Donner Lake
systems. Draft copies of the documents are attached to this memo.
The District is currently operating the Glenshire system under an "Out of Agency Service
Extension" approved by Nevada County LAFCo in January, 2002. The Out of Area Service
Extension anticipated the annexation of the service territory by the District, but conditioned the
acceptance of the application on an update to the Sphere of Influence, including a revised Master
Services Element. Inasmuch as the District acquired both the Glenshire system and the Donner
Lake system since the last Sphere of Influence Report,both service areas are included in the
Sphere update.
RECOMMENDATIONS
I recommend the Board of Directors take the following actions:
► Approve the Application for the Glenshire Water System Service Area Annexation.
► Adopt the Resolution of Application.
► Approve the Sphere of Influence Update including revised Master Services Element,
► Authorize the filing of the Application and Sphere of Influence Update with the Nevada
County Local Agency Formation Commission.

11. Property Tax Exchange
An agreement for property tax exchange (if relevant) must be in place prior to LAFCo approval. The
Tax and Revenue Code requires negotiation of such an agreement to be completed within 60 days of

initiation, or the LAFCo application is considered null and void. To assure satisfaction of this
requirement, LAFCo requires applications to be accompanied by documentation that property tax
negotiations have been completed.

14. Disclosure Requirements
Pursuant to Government Code Sections 56700.1 and 81000 et seq., any person or group of persons
acting in concert who directly or indirectly contribute 51,000 or more in support of or in opposition
to a change of organization or reorganization that has been submitted to Nevada LAFCo must
comply with the disclosure requirements of the Political Reform Act of 1974 applicable to local
initiative measures to be submitted to the electorate. These requirements contain provisions for
making disclosures of contributions and expenditures at specified intervals. Additional information
about the requirements pertaining to local initiative measures to be presented to the electorate can be
obtained by calling the fair Political Practices Commission at (916) 322-5660.

FOR THE ANNEXATION OF

REQUESTING THE LOCAL AGENCY FORMATION COMMISSION
TO TAKE PROCEEDINGS FOR THE ANNEXATION OF
THE GLENSHIRE MUTUAL WATER COMPANY SERVICE AREA
RESOLVED, by the Board of Directors of the Truckee Donner Public Utility District, that
WHEREAS, the Truckee Donner Public Utility District desires to initiate proceedings pursuant to
the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, commencing with
Section 56000 of the California Government Code, for the annexation of the Glenshire Mutual
Water Company service area into the District's service area; and
WHEREAS, notice of the intent to adopt this resolution of application has been given to each
interested and subject agency; and
WHEREAS, the territory proposed to be annexed is inhabited, and a description of the
boundaries of the territory is set forth in Exhibit A attached hereto and by this reference
incorporated herein; and
WHEREAS, this proposal is consistent with the sphere of influence of the District; and
WHEREAS, the reasons for the proposed annexation are as follows:
1, The Glenshire Mutual Water Company requested the transfer of the water
system to the District because of high arsenic level's in the Company's wells and their
insufficient capacity to meet anticipated future needs.
2. The District and the Glenshire Mutual Water Company executed an
"AGREEMENT FOR ACQUISITION OF THE GLENSHIRE WATER SYSTEM BY THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT" dated January 9, 2002, whereby the
ownership and operation of the water system was transferred to the District.
3, The District is currently providing water service to the subject territory pursuant to
an Out of Agency Service Extension approved by LAFCo under Resolution 02-01, dated
January 25, 2002, pending annexation of the said area.
WHEREAS, this Board of Directors certifies that pursuant to the California Environmental
Quality Act, the District adopted a Negative Declaration for the Glenshire Water System
Acquisition and Improvements on November 7, 2002, finding that the project will not have a
significant effect on the environment; and
WHEREAS, this Board of Directors certifies that, pursuant to Section 99(b) of the Tax and
Revenue Code, because the District does not collect any tax revenues, this proposal will not
involve the implementation of the Nevada County master tax formula; and
WHEREAS, this Board of Directors certifies that, pursuant to Section 56663 (d) of the
Government Code, the District, as the only agency that will gain or lose territory as a
result of this annexation, consents to a waiver of the final protest proceedings providing
no written objection from voters or land owners within the subject territory are received
prior to the conclusion of the Nevada LAFCo Commission hearing.
NOW, THEREFORE, this Resolution of Application is hereby adopted and approved by
the Board of Directors of the Truckee Donner Public Utility District, and the Local Agency
Formation Commission of Nevada County is hereby requested to take proceedings for
the annexation of the Glenshire water system service territory as described in Exhibit A,
according to the terms and conditions stated above and in the manner provided by the
Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000.

duly called and held within the District on the seventh day of August 2002 by the

STATEMENT OF JUSTIFICATION.
The proposed project involves the annexation of the Glenshire Mutual Water Company's water system
service territory by the Truckee Donner Public Utility District(District). The District's acquisition,
operation, and maintenance of the water system will provide water for domestic use and fire protection.
The Glenshire water system provides service to approximately 1,361 connections. The Glenshire Mutual
Water Company, on behalf of its members, approached the District with regards to the District's acquisition
of the Glenshire system with the District. The system is currently supplied by twelve wells of various
production capacities. Many of these wells have been undergoing a degradation in water quality including
increased levels of arsenic,radon, and iron. This prompted the Mutual Water Company to take action with
regard to securing a long term water supply of adequate quality and quantity. This has resulted in the
system's acquisition by the District.
The shareholders of the Glenshire Mutual Water Company conducted a vote in which there was
overwhelming support for acquisition of the water system by the District. With the support of the
shareholders as evidenced by the vote, the Company's Board of Directors approached the District with
regards to the District taking over the Glenshire system. The District took over the water system in January
2002. The District is currently providing water service to the Glenshire service area under an "Out of
Agency Service Extension" approved by LAFCo, Resolution 02-01. dated January 25, 2002. The
Out of Agency Service Extension anticipated this application for annexation.

I. INTRODUCTION
The Truckee Donner Public Utility District (referred to as the District or TDPUD) is an
independent special district. The TDPUD was incorporated on May 9, 1927 under the State of
California Public Utility District Act(See Appendix D for District enabling legislation). Districts
incorporated under this Act have the power of eminent domain. They are also authorized to incur
bonded indebtedness for the purpose of conducting works and for the acquisition of property.
District affairs are administered by a Board of Directors consisting of five members who are
elected at large for a term of four years by the qualified voters.
This Sphere of Influence Report was prepared for and adopted by the Truckee Donner Public
Utility District in 1998 in response to a request from the Nevada County Local Agency
Formation Commission (LAFCo) that Sphere of Influence Plans of agencies in Nevada County
be updated. The Sphere of Influence Report is again being updated to reflect recent additions to
the District's water service territory. These additions include the acquisitions of the Donner
Lake service area and the Glenshire service area.
LAFCo's are independent governmental bodies created for each county by state legislation
(Knox-Nisbet Act of 1963) to ensure that changes in governmental organization occur in a
manner which provides efficient and quality services. Among the purposes of a Local Agency
Formation Commission are the preservation of open space land resources, the discouragement of
urban sprawl, and the encouragement of the orderly formation and development of local
governmental agencies.
LAFCo must consider an agency's sphere of influence whenever it reviews a proposal for a
change of organization (i.e., annexation, etc.). A sphere of influence is defined as the probable
physical boundaries and service area of a local agency. LAFCo policy requires that spheres of
influence be outlined in five year increments.
The efficient development of the Truckee area, which includes areas of Nevada and Placer
Counties as well as the incorporated Town of Truckee, depends on quality planning on the part
of its governmental agencies and special districts. The District has prepared this report to assist
both Nevada County and Placer County LAFCos in making decisions related to development in
the Truckee area.
II. LAND USE
Development in the Truckee area is dependent upon decisions made by the planning departments
of the Town of Truckee, Nevada County, and Placer County. Land use designations for the
Town of Truckee are illustrated on Plate I. Land use designations for areas surrounding the
Town of Truckee including eastern portions of both Placer and Nevada County are shown on
Plate II.
Town of Truckee Land Use Designations
The following section is from the "Town of Truckee General Plan 1995-2014, Vol I, Goals and
Policies."` The Town General Plan was adopted February 15, 1996. This section was included

in this report to expound on the planning and land use concepts which will most affect the
Truckee Donner Public Utility District.
The following principles were developed to guide preparation of the Town of Truckee General
Plan.'
Provide for accommodation of projected growth within the planning period (1994 to 2014). Provide
a surplus of land available for development beyond the 20-year projections to accountfor unbuildable
residential lots and to ensure competition and flexibility in Commercial and Industrial land uses.
Locate significant new development around existing developed areas.
Designate an adequate amount of land in the Commercial Designation to accommodate projected
demand.
New freeway oriented commercial development shall be located at the existing developed
interchanges at Donner Pass Road/Cold Stream Road interchange and the State Route 89 South
interchange. Development on the north side of the Interstate 80/State Route 89 North interchange
shall not be freeway oriented and shall be substantially screened from Interstate 80. Development
on the south side of this interchange will be addressed through the Downtown Specific Plan process.
Future subdivision of estate type parcels (2.5-10 acre parcel sizes) is discouraged within the town
boundaries outside of existing rural subdivisions.
In order to provide opportunities for inf II development and help fund the need for a secondary access
road out of Tahoe Donner, increase densities on 700 acres east of Tahoe Donner.
Designate the Joerger property near the airport for a mix of commercial and Industrial uses.
Significant development in this area should not take place until the State Route 267 Bypass or other
major transportation improvements are in place.
Include policies in the General Plan which prevent"commercial sprawl'.
Design standards should be developed for freeway-oriented commercial development.
Develop design criteria for commercial projects that prohibit mass parking areas and large single
building forms.
Allow a mix of uses in Commercial areas. The mix can include office, residential, service, and/or
retail uses.
The following categories of land uses are shown on the Land Use diagram [Plate I]. For each
designation, the uses allowed and the standards of density and intensity are specified. Other
policies relating to these land use designations are found in the policy section of the Land Use
Element and throughout the Town General Plan.' The amounts of land in each type of land use
are shown in Table II-l.
