HomeMy WebLinkAbout4 Donner Lake Assessment Agenda Item # Memorandum To: Board of Directors From: Peter Holzmeister Date: January 11, 2002 Subject: Donner Lake Assessment District One of the required procedural steps in formation of an assessment district is to adopt a resolution determining the unpaid assessments after to offer has been made to allow property owners to pay in advance. Attached is a draft resolution that satisfies that requirement. You will notice that there are blanks in the draft resolution. Mary Chapman will be able to fill in those blanks, but she in on vacation this week. When she returns on Monday I will have here complete the resolution and get a final version to you. RECOMMENDATION: I recommend that the Board adopt the resolution determining unpaid assessments in Donner Lake Water Assessment District Number 00-1 RESOLUTION NO. RESOLUTION OF THE BOARD OF DIRECTORS OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DETERMINING UNPAID ASSESSMENTS IN DONNER LAKE WATER ASSESSMENT DISTRICT NO. 00-1 WHEREAS,this Board of Directors has taken proceedings under the Municipal Improvement Act of 1913, Division 12 of the California Streets and Highways Code (the"Code"), for the formation of Donner Lake Water Assessment District No. 00-1 (the "Assessment District') and has confirmed an assessment, which assessment and a related diagram were recorded in the office of the District Engineer, acting as the Superintendent of Streets, and with the County Recorders of the County of Nevada and the County of Placer; and WHEREAS, a notice of assessment, as prescribed in Section 3114 of the Code, has been recorded with the County Recorders of the County of Nevada and the County of Placer, whereupon the assessment attached as a lien upon the property assessed within the Assessment District as provided in Section 3115 of the Code; and WHEREAS, said proceedings provided that bonds be issued pursuant to the Improvement Bond Act of 1915, Division 10 of the Code secured by the unpaid assessments; and WHEREAS, a list of the assessments that were unpaid as unpaid as of _,2001, which is not less than 30 days after the recording of notice of assessment described above, has been filed with the Treasurer of the District pursuant to Section 8620 of the Code, and the Treasurer has filed with this Board of Directors a Certificate of Paid and Unpaid Assessments; NOW, THEREFORE, the Board of Directors of the Truckee Donner Public Utilities District HEREBY FIND, DETERMINE, RESOLVE AND ORDER as follows: SECTION 1. The above recitals, and each of them, are true and correct. SECTION 2. The unpaid assessments upon the security of which the bonds are to be issued is determined to be as set forth in the Certificate of the Treasurer of the District referred to in the recitals hereof. -1- DOCSOCl844299%2\22925.0003 SECTION 3. The Board of Directors of the Truckee Donner Public Utility District(the"Public Utility District') has taken proceedings under the Municipal Improvement Act of 1913, Division 12 of the California Streets and Highways Code(the "Code"), for the formation of Donner Lake Water Assessment District No. 00-1 (the"Assessment District')and has confirmed an assessment on property located in the Assessment District, which assessment and a related diagram were recorded in the office of the District Engineer, acting as the Superintendent of Streets, and in the offices of the County Recorders of the County of Nevada and the County of Placer. 2. 1 am the Treasurer of the Public Utility District, and as such I am the person to whom assessments imposed on parcels located in the Assessment District(the "Assessments") are to be paid. 3. Pursuant to Section 8621 of the Code, I have determined that the Assessments remaining unpaid as of 2001, which is at least 30 days after the date of the last of the aforesaid recordations, are those as so designated on the attached list of unpaid Assessments, that the aggregate amount of such unpaid Assessments is $ and that all other Assessments were paid in full.
