HomeMy WebLinkAboutRES 1987-02 - Board F RESOLUTION NO. 8702 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DECLARATION OF INTENT TO FORM AN IMPROVEMENT DISTRICT (HIRSCHDALE) WHEREAS, the Truckee Donner Public Utility District, a public utility district duly incorporated and existing pursuant to the provisions of the Public Utility District Act , Section 15501 et seq. of the Public Utilities Code of the State of California, proposes to form an improvement district in order to qualify for a grant from the Department of Water Resources of the State pursuant to the California Safe Drinking Water Bond Law of 1984 (Section 13810 et seq. of the Water Code of the State) , which improvement district shall be composed of the area described in Exhibit A attached hereto; and WHEREAS, Section 16407 of the Act provides that a public utility district has the same powers with reference to improvement districts as are conferred upon, among others, municipal water districts by Part 8 (commencing with Section 72000) of Division 20 of the Water Code of the State; and Section 72000 of such Part 8 provides that whenever the Board of Directors of the District deems it necessary to form an improvement district of the portion of the District for a purpose other than incurring of bonded indebtedness, the Board shall by resolution declare that it intends to form an improvement district which in its opinion will be benefited; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. Declaration of Intent and Benefit (Section 72000). The Board hereby declares that it intends to form the improvement district, and that in the opinion of the Board, such improvement district will benefit the District. 2. Purpose of Formation (Section 72001(a))_. The improvement district is to be formed for the purpose of qualifying for a water grant from the State. 3. Taxes (Section 72001(c)). Taxes, if any, for carrying out such purpose will be levied exclusively upon the taxable property in the improvement district; however , no taxes are anticipated to be levied. 5. Map of Exterior Boundaries (Section 72002). A maD showing the exterior boundaries of the proposed improvement district, with relation to the territory immediately contiguous thereto, is on file with the secretary of the District and is available for inspection by any person or persons interested. This map shall govern all details as to the extent of the improvement district. 6. Hearing (Section 72003). The Board shall hold a hearing at 7:30 P.M. on Monday, March 2 , 1987 , at the Tahoe Truckee Unified School District Board room located on Donner Pass Road in Truckee, California, on the questions of formation and extent of the improvement district , the purpose for which it is to be formed and the estimated expense of carrying out such purpose. At such time and place any person interested, including all persons owning property in the District or the improvement district, will be heard. 7. Notice of Hearing (Section 72004). Notice of hearing shall be given by publishing a copy of the resolution of intention prior to the time fixed for the hearing in a newspaper circulated in the District. Such publication shall be made once a week for two successive weeks (at least twice in a newspaper published once a week or more often with at least five days intervening between the respective publishing dates , not counting such publication date) , as required by Section 6066 of the Government Code of the State. Such notice shall also be given by posting a copy of the resolution of intention, in three public places within the improvement district for at least two weeks before the time fixed for the hearing. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a meeting duly called and held within the District this 2nd day of February, 1987 , by the following roll call vote: AYES: Cooley, Hamilton, Maass, Sutton and Corbett.
