HomeMy WebLinkAboutRES 1988-03 - Board c RESOLUTION NO. 8803 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT AUTHORIZING COMPETITIVE BIDDING WITH RESPECT TO A COMPUTERIZED MAPPING SYSTEM WITHOUT THE USE OF "OR EQUAL" PRODUCTS WHEREAS , the District has determined the need to acquire a computerized mapping system for use by the District's Engineering Department; and WHEREAS, District staff has conducted extensive research and determined that a system consisting of the components listed on Exhibit A, attached hereto and incorporated herein by reference , containing the specific components listed thereon, is the best system available for the cost , will fulfill the District's needs, and will be flexible with respect to the District's future needs; and WHEREAS, if the District accepts bids containing components of different manufacturers than those listed on Exhibit A, the District will be unable to evaluate such bids, because District staff lacks the necessary expertise and would , therefore, be required to employ outside consultants at considerable expense in order to evaluate such bids; and WHEREAS , the anticipated total cost of the computerized mapping system does not justify the considerable additional expense of employing outside consultants for the purpose of evaluating such bids; and WHEREAS, District Counsel has advised the Board of Directors that the bidding laws applicable to the District do not specifically require that the District allow bidders to submit "or equal" bids, although it is the District's general practice to do so; and WHEREAS , due to the facts set forth above , allowing potential bidders to submit components from other manufacturers which are claimed to be "or equal" would be unduly expensive to the District , unavailing, and would not produce an advantage to the District; and WHEREAS , District staff has advised that there are several suppliers who can submit competitive bids on the specific components listed on Exhibit A, so that the purchase of the computerized mapping system can be accomplished according to competitive bidding; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors that for the reasons set forth above, the District finds that allowing manufacturers other than those listed on Exhibit A to submit proposals would be unduly expensive , unavailing , and would not produce an advantage to the District. BE IT FURTHER RESOLVED that the District shall request competitive bids from manufacturers of such components for the computerized mapping system described on Exhibit A, attached hereto, and the District staff is directed le to take all steps necessary to request competitive bids for such system. PASSED AND ADOPTED at a regular meeting of the Board of Directors of the Truckee Donner Public Utility District duly called and held in said District on the 16th day of February 1988 by the following roll call vote: AYES: Aguera, Maass, Sutton, White and Corbett.
