OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
DIRECTING THAT SURPLUS PROPERTY
BE TRANSFERRED TO THE
TRUCKEE DONNER RECREATION AND PARK DISTRICT
WHEREAS, the District has determined that nine 32-foot steel
light poles that are approximately 32 years old and that have
been out of service for approximately 5 years are surplus
property, for which the District has no further use; and
WHEREAS, the General Manager has indicated the poles are
presently stored by the District, that they are a nuisance, and
that it is unlikely that any compensation would be received for
this property if it is sold at public auction; and
WHEREAS, the District General Manager has advised the
District Board of Directors that if a public auction is
conducted, it is likely that this property will not be purchased,
and the District will therefore be required to incur the expense
of disposing of property which is not purchased; and
WHEREAS, that considerable staff time would be needed, and
money expended, to advertise a public auction in the newspaper,
to conduct a public auction and to dispose of the surplus
property that is not purchased at a public action; and
WHEREAS, based on the District' s experience with similar
auctions of property, it is probable that the compensation, if
any, that the District would receive at a public auction is less
than the cost to the District of conducting the auction, and of
disposing of the surplus property that is not purchased at the
auction; and
WHEREAS, the Truckee Donner Recreation and Park District has
offered to take ownership of all of the light poles, for its use,
and to dispose, at its expense, of any poles that it cannot use;
and
WHEREAS, a representative of the Truckee Donner Recreation
and Park District has represented to District staff that the
Truckee Donner Recreation and Park District has no funds
that are available to be paid to the District as compensation for
such surplus property, other than a token payment of $1. 00;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors
that a finding is hereby adopted that there is a clear benefit to
the District in transferring the nine steel light poles to the
Truckee Donner Recreation and Park District, at no compensation,
in that the compensation that the District would most likely
receive from the surplus property at a public auction would be
�..., less than the expense to the District of conducting a public
auction and of disposing of whatever surplus property is not
purchased at the public auction.
BE IT FURTHER RESOLVED that the District General Manager is
authorized to take all steps necessary in order to accomplish the
transfer of such surplus property to the Truckee Donner
Recreation and Park District, and is authorized to execute any
bills of sale or related documents of transfer.
PASSED AND ADOPTED at a regular meeting of the Board of
Directors of the Truckee Donner Public Utility District duly
called and held in said District on the 6th day of June, 1988,
by the following roll call:
AYES: Aguera, Maass, Sutton, White and Corbett.
NOES: None.
ABSENT: None.
