HomeMy WebLinkAboutRES 1985-25 - Board RESOLUTION NO. 85-25 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT CURRENT AND ORDINARY REPAIRS AND CURRENT AND ORDINARY UPKEEP OR MAINTENANCE OF DISTRICT FACILITIES WHEREAS, Public Contract Code S20205.2, which applies to the District, provides that the Board of Directors may do or cause to be done directly by the District, without any contract, and thereby without competitive bidding, any or all work necessary or proper in or about the making of all current and ordinary repairs or in or about current and ordinary upkeep or maintenance; and WHEREAS, Public Contract Code S20205.2 lacks specificity, and neither the Public Contract Code, the Public Utility District Act, nor California court decisions provide guidance as to the types of tasks that are included within the definition of "current and ordinary repairs" and "current and ordinary upkeep or maintenance"; and WHEREAS, the District has trained and equipped crews capable of performing many types of tasks related to the District's electrical and water distribution system; and WHEREAS, in order that the District can respond quickly to the needs of its customers the District maintains an inventory of poles, wires, transformers, valves, pipes, switches, regulators, reclosers, and related equipment; and WHEREAS, nearly all such District inventory, including poles, wires, transformers, valves, pipes, switches, regulators, reclosers, and related equipment, were purchased by the District pursuant to competitive bidding procedure; and WHEREAS, District customers frequently require prompt assistance by the District in performing tasks related to the District's electrical and water distribution systems. If the District is unable to respond promptly to District customers, such customers may experience unnecessary, time-consuming and expensive delays, resulting in significant inconvenience, loss of business, and other potential damages; and WHEREAS, in order to maintain the water and electric crews' proficiency it is necessary that they regularly perform a variety of tasks of a type that they might later be required to perform in an emergency, possibly in severe storm conditions and at night. In order to maintain such proficiency, it is necessary that District crews remain familiar with District facilities and procedures so that they can respond in a prompt and safe manner in such unfavorable working conditions; and WHEREAS, quite often routine tasks, such as an electric service installation to a customer, could exceed the bidding limits of Public Contract Code §20201, even though the District labor involved is insignificant, merely because the price of an item of equipment required, such as a transformer, exceeds the bidding limits of Public Contract Code S20201. Generally, such equipment has previously been purchased by the District pursuant to competitive bidding procedures; and WHEREAS, District staff is in need of a clear policy and procedure statement that District staff can understand and follow with respect to those situations in which the District, in following the requirements of the Public Contract Code, need not engage in competitive bidding. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors that it is necessary to clarify and provide specificity with respect to Public Contract Code §20205.2 and to provide District staff with a clear policy and procedure statement. Therefore, the District hereby construes the terms "all current and ordinary repairs" and "current and ordinary upkeep or maintenance," as contained in Public Contract Code S20205.2, to include the repair, upkeep and maintenance of the entire District water and electrical distribution systems, to allow for routine extension and expansion of District electrical and water facilities to meet the increased demand placed on such systems by the growing needs of District customers, and to include minor and routine work which District staff is capable of performing. Such work shall include, but shall not be limited to, the following: (a) Reconductoring of up to a distance of 1/2 mile; (b) Pole relocation up to a distance of 1/4 mile; (c) Routine pole replacement of broken or deteriorated poles, or where a size or height increase is needed; (d) Electrical work on energized lines; (e) Pulling of underground cable in conduit systems, and installation of overhead conductors and poles up to a distance of 1/2 mile; (f) The making of underground electrical splices and terminations; (g) The installation of transformers, switches, regulators, reclosers, and related equipment that is either provided by a customer at the customer's expense or acquired by the District by competitive bidding procedure; (h) The installation of water taps and related work; (i) The installation of water street crossings; (j) The installation of equipment such as valves, pressure reducing devices, back flow prevention devices, and similar equipment; and (k) Minor water line extensions, such as that needed to compete a water loop system, having a length of 500 feet or less. The list set forth herein is not exclusive, and the District may determine that other similar types of work are included within the terms "current and ordinary repairs" and "current and ordinary upkeep or maintenance" as contained in Public Contract Code §20205.2. The General Manager shall keep the Board advised periodically of such current and ordinary repairs, upkeep and maintenance performed by the District.
