HomeMy WebLinkAboutRES 1989-19 - Board RESOLUTION NO. 89/ OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT APPROVING SPECIFICATIONS AND CALLING FOR BIDS ON GARAGE HEATERS WHEREAS, the Board of Directors of the Truckee Donner Public Utility District has determined the need to purchase and install heaters in the garages; and WHEREAS, funds have been set aside in the 1989 budget for this purpose; NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Truckee Donner Public Utility District does hereby authorize the President to issue a call for bids based on the specifications attached hereto, and that the date and time established for the bid opening is Wednesday, August 16, 1989 at 2: 00 P.M. If you have any questions about the specifications, please contact Tom Buckhouse, Electrical Engineer, at the number above. The Truckee Donner Public Utility District specifically reserves the right to reject any and all bids, waive irregularities or informalities in any or all bids, be the sole judge of the �-� suitability of the items offered, and to accept any bid that it determines to be in its best interest. Buckhouse, Electrical Engineer FORM OF PROPOSAL RADIANT HEATING SYSTEMS FOR VEHICLE MAINTENANCE GARAGES Bid opening - 2: 00 P.M. - Wednesday, August 16, 1989 The undersigned hereby certifies that he has read the plans, specifications and contract documents and hereby submits a bid for providing and installing radiant heating systems for the Truckee Donner Public Utility District's vehicle maintenance garages in accordance with those documents. Bid amount $ Total bid (in words) The bid price shall remain in effect for a period of 60 calendar days from the date of the bid opening. If the bid is awarded to me I agreed to complete the project within three months from the date the notice to proceed is received. LIST OF SUPPLIERS/SUB-CONTRACTORS (names and addresses) Name, address and telephone number of bidder: RADIANT HEATING SYSTEMS FOR THE TDPUD VEHICLE MAINTENANCE GARAGES This agreement is made this day of 1989, at Truckee, Nevada County, California, by and between the TRUCKEE DONNER PUBLIC UTILITY DISTRICT and (Contractor) . In consideration of the mutual covenants and conditions hereinafter set forth, owner and contractor hereby agree as follows: 1) STATEMENT OF WORK The project is fully described in the plans and specifications attached hereto. 2) CONTRACT PRICE The District shall pay contractor the amount of $ for performance of this project. 3) PAYMENT Payment will be made by the loth of the month following completion of work and receipt of invoice by the District. 4) GUARANTEE Contractor shall guarantee all work done under the contract for a period of one year from the date of completion of the project. Should the workmanship or materials prove defective in the opinion of the District, the work shall be removed and replaced at the Contractor's expense. 5) COMPENSATION INSURANCE The Contractor shall procure and shall maintain during the life of the contract, Workmen's Compensation Insurance for all of his employees to be engaged in work. In case of any such work sublet, the Contractor shall require the subcontractor similarly to provide Workmen's Compensation Insurance for all of the latter's employees to be engaged in such work unless such employees are covered by the protection afforded by the Contractor's Workmen's Compensation Insurance. 1 6) PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE Contractor shall furnish satisfactory proof, by certificate presented to the District within ten days of the date of the contract, that he has public liability and property damage insurance. The insurance shall protect both the Contractor and the District, its officers a/d/or agents against loss from all liabilities imposed by law, and shall be maintained in full force and effect during the performance of the contract and in the following amounts: a) Limit of liability for personal injury or accidental death - one person, $500,000; aggregate liability per accident, $1, 000, 000. b) Limit of liability for property damage - one occurrence, $50, 000; aggregate liability for loss per accident, $100,000. 7) NOTICE TO PROCEED Contractor shall complete the project within three months from the date the notice to proceed is received. 8) ADJUSTMENT OF DISPUTE All questions or controversies which may arise between the Contractor and the District under or in reference to this contract shall be subject to the decision of some competent person to be agreed upon by the District and the Contractor who shall act as referee, and his decisions shall be final and conclusive upon both parties. Should the District and the Contractor be unable to agree upon a referee, a board of three arbitrators shall be chosen, one by the District, one by the Contractor, and the third by the two so chosen, and the decision of any two of said arbitrators shall be final and binding upon the parties. If either party to the contract neglects or fails for a period of ten days after notice from the other party to designate an arbitrator hereunder, the arbitrator designated by the other party shall have full power to decide the dispute in the same manner as though a board of three arbitrators had been selected. The referee or arbitrators shall decide which party shall pay the cost of referral or arbitration. 2 f 9) SERVICE OF NOTICES All notices required to be given hereunder shall be mailed or delivered to the addresses shown under the District's and Contractor's signatures at the end of this contract. 10) EXTRA WORK Any alteration or deviation from this contract involving extra costs will be executed only upon written notice and will become an extra charge over and above the bid amount.
