HomeMy WebLinkAboutRES 1989-31 - Board 1 RESOLUTION NO. 8931 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT REQUESTING FROM THE BOARD OF SUPERVISORS OF THE COUNTY OF NEVADA APPROVAL OF PROPOSED RESOLUTION OF INTENTION AND EXTENT OF TERRITORY TO BE INCLUDED IN PROPOSED ASSESSMENT DISTRICT, AND CONSENT FOR THIS BOARD TO ACQUIRE PUBLIC IMPROVEMENTS UNDER APPROPRIATE SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS ASSESSMENT DISTRICT NO. 1989-1 (HIRSCHDALE) WHEREAS, it is the intention of the Board of Directors of the Truckee Donner Public Utility District to undertake special assessment and assessment bond proceedings for the acquisition of the public improvements more particularly described in Exhibit "A" hereto attached and by this reference incorporated herein; and WHEREAS, this Board proposes to assess the costs of the improvements and the expenses incidental thereto upon an assessment district benefited thereby; and WHEREAS, all of the lands to be assessed are within the boundaries �^ of the District and situated within the unincorporated area of the County of Nevada; and WHEREAS, portions of the improvements proposed to be acquired are outside the boundaries of the District, within the unincorporated area of the County; and WHEREAS, in order to undertake such proceedings, this District must submit, pursuant to Section 10104 of the Streets and Highways Code of the State of California, to the Board of Supervisors of the County of Nevada for approval the proposed Resolution of Intention to form the assessment district and a plan or map indicating by a boundary line the extent of territory included in the proposed assessment district; and WHEREAS, this District must, pursuant to Section 10103 of said Code, obtain the consent of the Board of Supervisors of the County of Nevada to work done outside the boundaries of the District but within the unincorporated area of the County; and WHEREAS, the public interest, convenience and necessity will be served by the making of the acquisitions and the levying of the assessments as contemplated in the proposed Resolution of Intention; and �,.,. WHEREAS; the purposes sought to be accomplished through these proceedings can best be accomplished by a single, comprehensive scheme of work; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That request be, and the same is hereby made of the Board of Supervisors of the County of Nevada to approve, by resolution, the District's proposed Resolution of Intention to form the assessment district and the extent of territory to be included in the proposed assessment district. 2. That request be, and the same is hereby made of the Board of Supervisors of said County that it consent to this District's acquisition of the public improvements under appropriate special assessment and assessment bond acts. 3. That the District Clerk is hereby directed to file with the Clerk of the Board of Supervisors of the County of Nevada a certified copy of this resolution, together with a copy of the proposed Resolution of Intention and a plat or map indicating by a boundary line the extent of the territory included in the proposed assessment district. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a meeting duly called and held within the District on the 2nd day of October, 1989, by the following roll call vote: AYES: Corbett, Sutton, White and Maass.
