RESOLUTION NO. 8731
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
APPROVING AGREEMENT KITH CORNELL/BRADLEY
WHEREAS , Truckee Donner Public Utility District staff has prepared an
agreement between Zekiel Cornell/Juliet Bradley and the District concerning
the water distribution system installed in connection with the subdivision
of three residential parcels, copy of which is attached hereto; and
WHEREAS, District Counsel Phelps has reviewed the proposed agreement and
found it to be in order;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee
Donner Public Utility District as follows:
1. That the agreement between Zekiel Cornell/Juliet
Bradley and the District is hereby approved.
2. That the President of the Board is authorized to
execute such agreement.
3. That the Clerk of the Board is directed to record
the agreement with the County of Nevada.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public
Utility District at a meeting held within said District on the 20th day of
July, 1987 by the following roll call vote:
AYES: Aguera, Cooley and Sutton.
NOES: None.
ABSENT: Corbett and Maass.

AGREEMENT CONCERNING WATER SERVICE
BETWEEN THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
AND
ZEKIEL CORNELL & JULIET BRADLEY
This agreement is made between the TRUCKEE DONNER PUBLIC UTILITY DISTRICT,
a local public agency of the State of California, hereinafter referred to
as "District", and ZEKIEL CORNELL AND JULIET BRADLEY, hereinafter referred
to as "Developers", with reference to the following.
This agreement is predicated upon the following facts:
RECITALS
A. Developers are the sole owners of that certain real property located
within Nevada County, California, bearing Assessor's Parcel number 18-790-
10. y
B. Developers intend to develop Assessor's Parcel Number 18-790-10, here-
after referred to as the "Project", by subdividing it into 3 residential
lots.
C. Developers have constructed a complete water distribution system for
the project for consumptive and fire protection use, including pipe, valves,
fire hydrant and related equipment. The District will accept the water dis-
tribution system according to the terms and conditions outlined in that cer-
tain Development Agreement between Developers and District dated March 1,
1987.
The parties agree as follows:
1. The District will supply water to two water service boxes within Dis-
trict's Sitzmark Station site for service to Parcels B and C, and one ser-
vice for Parcel A at the Tirano cul-de-sac following conditions of said .
Development Agreement. Developer shall accept full responsibility for
provision of service from said service boxes to Parcels A, B and C, in
cluding the location of service lines, which may traverse adjacent parcels,
and Developer shall further accept full responsibility for maintenance of
adequate pressure from said service boxes.
2. According to the terms of Development Agreement, in order to avoid
stagnant water conditions, it may be necessary to flush water through .the
system by opening the hydrant at Tirano cul-de-sac from time to time.
Provisions for drainage are the sole responsibility of the Developer.

SUCCESSORS AND ASSIGNS
3. This agreement shall be binding upon and inure to the benefit of the
successors and assigns of both parties, however, Developers shall not assign
any of their rights, duties or obligations under this agreement without the
prior written consent of the District.
This AGREEMENT shall be binding upon the parties only when signed by all
parties.
