TRUCKEE DONNER PUBLIC UTILITY DISTRICT
DIRECTING THAT COMPETITIVE BIDDING BE DISPENSED WITH IN
CONNECTION WITH THE DISTRICT'S PURCHASE OF RECLOSERS AND
RECLOSER CONTROLS

WHEREAS, the Truckee Donner Public Utility District has determined the need to acquire Cooper
Power System reclosers and microprocessor-based recloser controls; and
WHEREAS, Public Contract Code Section 20206.4 generally requires that the District seek
competitive bids in connection with the purchase of goods; and
WHEREAS, various California court decisions, including Graydon v. Pasadena Development
Agencv. 105 C.A. 3d 631 (1980), hold that if the subject of a contract is such that competitive
proposals would be unavailing or would not produce an advantage, and the advertisement for
competitive bid would thus be undesirable or impractical, a public agency may dispense with
competitive bidding; and
• WHEREAS, the District has a large investment in the Cooper Power Systems reclosers and
controls, using them exclusively; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls reduces costs in
inventory of parts, and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls allows for inter-
changing within the system; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls does not require
additional training of District personnel- and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls will be more
compatible with future SCADA plans; and
WHEREAS, the exclusive use of Cooper Power System reclosers and controls has the potential
of shortening outages by staff being familiar with the same equipment from station to station; and
WHEREAS, due to the facts set forth above, competitive bidding would be unavailing and would
not produce an advantage to the District, and the advertisement for competitive bids and the
delay that would therefore result, would be undesirable;

• NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public
Utility District as follows:
1. That the recitals set forth above are adopted as findings and for the reasons set
forth herein finds that competitive proposals for the above described electrical
apparatus would be unavailing, would not produce an advantage to the District and
the advertisement for competitive bids and the resulting delay would be
undesirable.
2. That District staff is hereby authorized to dispense with competitive bidding and
purchase Cooper Power System reclosers and microprocessor based recloser
controls at this time and in future years.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the
District on the 5th day of July 1995 by the following roll call vote:
AYES: Hemig, Maass and Jones.
ABSTAIN: Sutton.
ABSENT.- Aguera.
