A RESOLUTION OF APPLICATION
BY THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT
REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO
TAKE PROCEEDINGS FOR THE
GOOSENECK RANCH ANNEXATION
RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that:
WHEREAS, the Truckee Donner Public Utility District desires to initiate proceedings
pursuant to the Cortese-Knox Local Government Reorganization Act of 1985,
commencing with Section 56000 of the California Government Code, for the Gooseneck
Ranch Annexation; and
WHEREAS, notice of intent to adopt this resolution of application has not been given to
each interested and subject agency; and
WHEREAS, the territory proposed to be annexed is uninhabited, and a description of the
boundaries of the territory is set forth in Exhibit A attached hereto and by reference
incorporated herein; and
WHEREAS, this proposal is consistent with the sphere of influence of the affected District;
and
WHEREAS, it is desired to provide that the proposed Gooseneck Ranch Annexation be
subject to the following terms and conditions:
Provisions of water service by the Truckee Donner Public Utility District will
require that the project developers enter into a development agreement with
the District; and
WHEREAS, the reasons for the proposed Gooseneck Ranch Annexation are as follows:
To provide water service; and
WHEREAS, this Board certifies that.
The Truckee Donner Public Utility District reviewed the Draft and Final
Environmental Impact Reports of the Gooseneck Ranch as prepared for
Placer County and concurs with the conclusions therein as they pertain to
the District's area of expertise; i.e., a water supply and distribution system
for Gooseneck Ranch. Said reports were filed with Placer County on
February 17, 1994. Findings pursuant to the California Environmental
Quality Act are attached as Exhibit B and by reference incorporated herein;

WHEREAS, this Board certifies that pursuant to Section 99(b) of the Tax and Revenue
Code:
Although the jurisdictional change would affect the service of the applicant,
the applicant does not receive property tax revenues from either Nevada
County or Placer County and, therefore, there is no need for the applicant
or the Board of Supervisors of either County to engage in a tax exchange
agreement; and
WHEREAS, this Board certifies that, pursuant to Section 56837(c) of the Government
Code:
LAFCo is authorized to waive the Conducting Authority hearings entirely
because: (1) the subject area is uninhabited; (2) all owners of the land
within the affected territory have given their written consent to the
reorganization, and (3) the applicant, the Truckee Donner Public Utility
District, is the only affected agency which will gain territory as a result of
the reorganization and consents to a waiver of the Conducting Authority
hearings.
• NOW, THEREFORE, this Resolution of Application is hereby adopted and approved by
the Board of Directors of the Truckee Donner Public Utility District and the Local Agency
Formation Commission of Nevada County is hereby requested to take proceedings for
the annexation of territory as described in Exhibit A, according to the terms and
conditions stated above and in a manner provided by the Cortese-Knox Local
Government Reorganization Act of 1985.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held
within the District on the third day of April 1995 by the following roll call vote:
AYES: Aguera, Hemig, Maass, Sutton and Jones.
NOES: None.
ABSENT: None.
