WHEREAS: The Truckee Public Utility District for the pact
Z years has made repeated appl is at ion to the
Sierra Pacific Power Company for adequate service
to enable the District, to in turn, serve its
customers with dependable and adequate service, and,
WHEREAS. The refusal of the Sierra Pacific Power Company to
grant such service, except upon its own stipulated
terms and conditions, which would restrict the
District' s field of operations to a very limited
area, approximately 10% of its duly and legally con-
stituted boundaries, as designated by the will of
the people and prescribed by law, and,
WHEREAS: Such refusal has greatly hampered the ability of the
District to operate its facilities in an efficient
and reliable manner, and in the best interests of its
customers, which has resulted in great financial loss
to the District, as well as much loss of confidence
and good will among its customers, and,
WHEREAS: Such refusal has resulted in the District's inability
to serve its customers with the highest and best type
of service they require, which has necessitated such
customers having to directly apply to the Sierra Pacific
Power Company for service, and,
WHEREAS: The operation of the District's Electric System during
the past 30 years has resulted in effecting the lowest
rates for Electric Service in the Eastern Sierra
Nevada Mountain area; which rates are less than the
customers of the Sierra Pacific Power Company enjoy in
the major portion of this area, and,
WHEREAS: By reason of the refusal of the Sierra Pacific Power
Company to grant the District adequate service to meet
its needs and for the further reasons herein set forth,
the Sierra Pacific Power Company is now offering to
purchase or lease the District ' s Electric System, with
a promise to improve and give adequate, dependable
service to the District' s customers, which it will not
presently permit. the District to fully render because
of the reasons set forth;
NOW THEREFORE BE IT RESOLVED: That the offer of the Sierra. Pacific
Power Company to purchase or lease the District 's
Electric System be, and is hereby refused, because in
the judgement of this Board,
A- It is made under duress and severe, adverse
and detrimental conditions, brought about by
the Sierra Pacific Power Company for the
direct purpose of effecting the purchase of
the District 's facilities, and
B- It is not in the best interests of the District
or the inhabitants thereof,, and

IT FURTHER RESOLVED, that the District take immediate steps
to apply to the California Public Utilities Commission
for relief from the deplorable conditions set forth
aR herein, and, for an order directing the Sierra Pacific
Power Company to serve the District with adequate power
to meet its present and future needs throughout the
t� District, and
FURTHERMORE,, BE IT RESOLVED, that copies of this Resolution be
sent to the Sierra Pacific Power Company, the California
Public Utilities Commission and any other interested
parties ,
Passed and adopted by the Board of Directors on this
