HomeMy WebLinkAboutRES 1970-09 - Board RESOLUTION OF THE BOARD OF DIRECTORS TRUCKEE DONNER PUBLIC UTILITY DISTRICT RESOLUTION NO, 7009 EFFECTIVE May 1, 1970 SUPERSEDING RESOLUTION NO, 6911 PREAMBLE WHEREAS: The District is engaged in rendering Public Utility services to the Public and the Employees, Management and Directors', recognize that there is an obligation on each for the continuous rendition and availability for such services ; and WHEREAS: The welfare of the Public depends upon the loyal and efficient work and service of all employed or associated with the District in any capacity; and, individually and collectively all are expected to use their influence and best efforts to protect the properties of the District and its service to the Public and to cooperate in promoting and advancing the welfare of the District and in preserving the continuity of its services to the Public at all times; NOW, THEREFORE BE IT RESOLVED, that for the purposes of promoting harmony and efficiency among the employees of the District, The Board of Directors propose, agree and herein set forth the fo l lowing: TITLEJ . RECOGNITION (a) District shall deduct from their wages the regular membership duel of employees who are members of Union and who individually and voluntarily authorize such deductions in writing in accordance with the provisions of Section 1157 .3 of the Gover ent Code of the State of California . Such deductions shall be mode from the First payroll period of each month and shall be submitted forthwith to the Financial Secretary of Local Union 1245, I .B.E.W. , 1218 Boulevard Way, Walnut Creek, California 94595, The for of checkoff authorization shall be approved by District and Union. Page 8 7 TITLE 2 CONDITIONS OF EMPLOYMENT (a) Employees shall be classified as either regular or casual (temporary) . (b) A regular employee is one who has completed six months of continuous service with the District. (c) A casual (temporary) employed is one hired for occasional or seasonal work or for a limited time. (d) New employees hired for a regular classification shall be placed upon a six months probationary period, at the end of which time, if (s)he has demonstrated his ability and qualifications 'therefore, (s)he shall be given a definite class if icat ion as hereinafter set forth. TITLE 3 WORKING HOURS (a) The established workweek for all employees is from Saturday midnight to Saturday midnigh t. (b) The normal workweek shall be f ive (5) days of eight (8) hours each, and shall begin on Monday and end Friday. (c) The hours of work for those employees scheduled on a Monday - Friday workweek shall be 8 .*00 a.m. to 12 :00 noon, and from 1:00 p.m, to 5 :00 p.m. Or 8:00 a.m. to 12 :00 noon, and from 12 :30 p.m, to 4:30 p.m. (d) The normal workweek for Service employees shall be five (5) days of eight (8) hours each, and shall begin on Tuesday and end Saturday. (e) The hours of work for those employees scheduled on a Tuesday - Saturday workweek shall be 8:00 a.m. to 12 :00 noon and from 1:00 p.m, to 5 :00 p.m. Or 8:00 a.m. to 12 :00 noon and from 12 :30 p.m, to 4 :30 p.m. (f) Nothing contained herein shall be construed as limiting the .right of the District to schedule Service employees to a Monday - Friday workweek. (g) Service employees are designated as : Serviceman/Warehouse- man, Service Utilityman, and Meter Reader/Co llec tor/Service- man. -3- TITLE 4 STANDBY For one man (alt ernated) in Electric and Water Department each over weekend (63 hours) 8 hours regular pay, plus 4 hours regular pay for holidays . TITLE 5 OVERTIME (a) An employee having to work through a lunch period shall be paid overtime. (b) An employee required to perform work before 8:00 a.m. or after 5 :00 p.m. on any regular work day shall be paid over- time. (c) An employee required to perform work on a recognized holiday or after 5:00 p.m. Friday and before 8.a00 a.m. Monday shall be paid overtime. (d) Overtime shall be computed to the nearest quarter hour. (e) Any Employee called outside of regular work hours shall be allowed not less than two hours pay at the overtime rate. (f) Overtime compensation shall mean a rate of pay equivalent to one and one-half (1k) times the Standard rate of pay. TITLE 6 HOLIDAYS The following are the recognized paid Holidays allowed by the District : New Years Day -4 - - - - - - - - - - - Januaryls t Washington 's Birthday - - - - - - - - - February 22nd Memor ial Day - - - - - - - .. .. _ - - - May 3 0 th Independence Day - - - - - - - - - - - July 4th Labor Day - - - - - - - - - - - - - - - First Monday in September Veteran's Day - - - - - - - - �- - - - November l lth Thanksgiving Da Fourth Thursday in November The Day (Friday) af ter Thanksgiving Day Christmas Day - - - - - - - as - me - - - December 25th When any of the allowed holidays fall on a Saturday, the paid holiday will be observed on Friday preceding; if a holiday falls on a Sunday, the following Monday will be observed. -4- TITLE 7 TRANSPORTATION (a) At the discretion of the District, transportation shall be furnished all employees in the performance of their duties as prescribed. (b) Any employee asked to use his own personal means of transportation for District business shall be reimbursed at the rate of 12� per mile, but shall not receive less than $1.00 per day. TITLE $ LEAVE OF ABSENCE (a) Leave of absence shall be granted to regular employees for urgent substantial personal reasons, provided that adequate arrangements can be made to take care of the employee 's duties without undue interference with the normal routine of work. Leave will not be granted if the purpose for which it is requested may lead to the employee 's resigna- tion. (b) An employee 's status as a regular employee shall not be impaired by a leave of absence. (c) An employee shall be paid his regular salary if leave of absence is occasioned, by a call, to fury duty. However, any pay received as a Juror shall be deducted from the employee 's wages . An employee may be paid his regular salary while in Civil Defense duly, or in connection wi th National Guard duty. TITLE 9 VACATION !a) An employee who has worked as a regular employee for the District for a period of twelve consecutive months shall be entitled to ten work days with full pay. (b) An employee who has completed eight years of continuous service with the District shall be entitled to f if teen (15) work days with full pay. (c) All vacations will be taken on consecutive days unless other- wise mutally agreed upon between the District and the employee. Vacation periods may be split only once if not taken on consecutive days . -5- (d) Any employee who shall leave the District before taking his regular scheduled vacation, shall be entitled to receive full pay for the days covered by hie vacation period. (e) Vacations may be scheduled at any time f rom the f irs t of the year to the end of the year by mutual agreement of District and employee. (f) Before April 1st of each year, there will be a sign up in each department so that employees may designate their choice of vacation periods . The District, shall prepare and post the annual vacation schedule on the basis of such sign up, effecting, wherever possible, the selections of the employees in the order of their seniority classification. Vacation lists shall be posted on or before April 15th of each year. TITLE 10 SAFETY (a) Safety belts for the electric department shall be furnished at the expense of the District. Every effort should be made by the employee to maintain them in good condition because his safety may depend on his equipment. (b) Safety meetings shall be allowed during the course of regular working hours , to be scheduled at a time agreeable to the Superintendent and Manager, approximately four hours each month. (c) The District shall make reasonable provisions for the safety of employees in the performance of their work. Employees shall ,jointly cooperage in promoting the responsibility of the individual employee with regards to the prevention of accidents . (d) The Foreman shall establish a safety inspection comm ittee to function in the prevention of accidents by ascertaining unsafe working conditions and at least every six months recommend any measures to be taken for correction thereof, in writing to the Manager. (e) The District reserves the right to draft reasonable safety rules for employees and to insist on the observance of such rules . -6- TITLE 11 UNION ACTIVITY 6� The District will not discriminate against an employee because of his membership in a Union, and �.ay" are expected not to discriminate against ,any employee because of his non- affiliation with a union. TITLE 12 SICK LEAVE (a) Employees who have completed fix months of continuous service with the District shall comanence accruing sick leave at the rate of one day per month- to a maximum of sixty (60) days . (b) The District may require medical certification for verifica- tion of prolonged illness which is considered to be 3 or more days . (�) Nothing in the foregoing articles shall be interpreted to entitle the employee to sick lease while on vacation, temporarily laid off by the District, upon severance of employment, or while receiving industrial compensation. TITLE 13 FUNERALS Three days paid time off for attending fwierals of immediate family members only. T ITLE 14 EXPENSES (a) If the District requires an employee to perform work start- ing two (2) hours or more prior to his regular starting time it shall provide him with a meal. (b) If the District requires an employee to perform work for one and one-half (1k) hours or more beyond his regular quitting time it shall proVide him with a meal, and with meals thereafter at intervals of four (4) hours , but not more than .five (5) hours for as long as such work continues . (c) The cost of any such meals and the time necessary to consume the same shall be at District 's expense. Time taken to consume th ese meals up to one♦half hour shall be con- sidered as work time. (d) If an employee, who is entitled to meals at District's expense doffs not accept any such meal, the District shall neverthe- less allow him time with pay equivalent to the time usually taken to eat a meal, namely one-half ('�) hour. -7- TITLE 15 GRIEVANCE PROCEDURE (a) As the �,nitial step in the adjustment of a grievance the employee and/or Shop steward or other representative shall discuss the same with the manager. Should the grievance still not be settled to the satisfaction of the employee, he shall be granted a hearing by a joint grievance committee composed of an impartial representative to be selected by mutual agreement between a representative of the District and the employees ' representative. In the event the District 's representative and the employees ' representative are unable to reach a satisfactory settlement of grievance the parties together may agree upon the appointment of a mediator. A grievance introduced at the initial step must be presented not more than 30 days from the date of the incident, or the date the employee becomes aware of the incident. TITLE 16 LAY OFF & DEMOTION PROCEDURE (a) Nothing contained herein shall be construed as limiting the right of the District to dete ine the methods of its operation, the amount of production, the number of employees in total or in specific classifications of work. However, the District agrees that in no case will it lay off employes as the result of work contracted. When it becomes necessary to lay off employees due to lack of work, the District shall '6 give employees concerned as much notice as possible except in the case of temporary employees when no notice is required. (b) Layoff in all cases will be made by penority and qualifica- tions . District will make a reasonabl� effort to notify job vacancies which occur withip 12 months following the layoff. Employees rehired in �he 12 month period will be reinstated with all benefits for which they qualified as a regu�ax emp Joyee. Except in the case of a' temporary employee where no rehire status is neces8ary. (c) Journeymen who can demote Apprentices; shill retain journeyman status , (linemen, line working foremen.) -8- EXHIBIT "A" FOREMAN , LINE , WORKING An employee engaged in performing all classes of distribution line work, having full charge of and directing entire crew, may at times be required to drive vehicle. Must be a Journeyman Lineman with not less than two years experience as such. Is required to drive the line truck and operate the fixed and attached equipment. Will keep time cards and material records and other duties as prescribed by District Manager. Must have a valid California driver 's license before assignment to job, Hourly rate : $5.81 Effective May 1970 LINEMAN An employee who is a journeyman And who performs all classes of transmission and distributiop line work when assigned to a crew under the direction of a Working Foreman or Supervisor of higher grade. His background of apprenticeship and experience must be such as to qualify him to perform these duties with skill and efficiency,, A Lineman may be assigned to work with and under the general direction of a Troubleman and when so assigned, the type of work he performs and the method of supervision shall be governed by the rules with respect to the Troub leman classificationS A Lineman may be assigned "temporarily to work apart from a crew either alone or as a member of a two (2) man unit, without supervision, doing work which may include* 1. Framing poles 2. Preassembling material 3. Patroling and inspecting pole and tower lines 4. Testing and inspecting poles 5. Repairing risers and ground mouldings . 6. Pulling slack in Anchor guys 7. Replacing guy guards 8. Trimming trees I A Lineman may be assigned temporarily to work apart from as a member of a two (2) man unit without supervision when the second man in such unit if; a one year apprentice lineman or higher, doing work which 'shall,.,include: �.�". 1. Taking primary distribution volt4ge readings 2 . Installing Company-owned customer outdpor fighting service equipment and Street Lighting fixtures including making connections on circuits with voltage below 750 volts , 3. Installing all types of Customer 's services including risers and terminal connections when the service is to be under- ground, complete with setting self-.contained meters . 9 Using special design lift equipment, or an aerial bucket, a Lineman may work apart from a crew, a twq (2) man unit, without supervisor, when the second man in such unit is a one-year apprentice Lineman or higher, doing work which may include : to Setting and replacing servile poles 2 . Setting street light poles and outdoor lighting service poles not to exceed forty (40) feet in length. 3e Washing insulators on lines energized up to 60 KV When it is necessary to climb through live circuits of 750 volts or more, the other employee in the two (2) man unit shall be a Journeyman Lineman. Is required to drive the line truck and operate the f ixed and attached equipment May be required to keep time cards and material records and other duties prescribed b District Manager. Must have a valid California driver's license before assignment to fob. Hourly Rate : $5.39 Effective May 1, 1970 , APPRENTICE LINEMAN Apprentice $4oO7 After one year 4*35 After two years 4o7O After three years 5*04 After four years 5o39 An employee who is engaged in performing work as an assistant to or under the general direction of a Lineman while training for journeyman. In order to gain experience for advancement, he may be required to work alone or under the direct supervision on jobs for which he has been trained and instructed. May be required to do other duties as prescribed by District Manager. The Employee 's education and general qualifications must be such that he is considered capable of attaining journeyman status . To qualify as a journeyman, employee must have a valid California lriver s license before assignment of job. WATER DEPARTMENT WORKING FOREMAN An employee working with and directing men assigned to his department engaged in construction and maintenance work. Must be skilled in the craft in which he works. Possessing the qualifications of serviceman, interpreting plans , sketches and instructions , perform clerical work related to the job. Is required to operate equipment before assignment to job. Is responsible for the operation and routine maintenance of water treatmen'- equipment and machinery and such other duties as prescribed by District Manager. Hourly Rate $5.21 Effective May 1, 1970 10- SERVICEMAN An employee who must be able to install water services , perform construction and maintenance duties in the Water Department. He must have a valid California Driver 's license and operate all Public Utility District 's construction equipment . He must be capable of reading and repairing meters and assist in the Warehouse or any other duties as required by the District Manager. Hourly Rate $4.74 Effective May 1, 1970 WAREHOUSEMAN/ SERVICE UTILITY MAN An employee who is qualified to perform, without direct super- vision routine duties , including the receipt, storage, and disburse- ment of materials , the taking of physical inventories , etc. May also be required to keep stores ' records . May operate equipment and be required to set electric and water meters and make electric and water cut ins and cut outs , make electric connections at the weather head, make minor repairs to Distr�pt and customers ' equipmen to May be required to collect and perform other duties as prescribed by the District Manager. Employee must have a valid California driver 's license before assignment to the fob. Hourly Rate $4.44 Effective May 1, 1970 METER COLLECTOR/SERVICEMAN An employee in this classification is required to read meters for any purpose as assigned and as part of his duties will be expected to cheek meter numbers records , record meter readings on forms as required observe and report any unusual or abnormal conditions of District;s or customer 's equipment. In addition to the above, he may be required to do routine collecting of accounts , cut in or cut out electric and water meters for any reason, assist in the Warehouse and Water department and perfo other duties as pre- scribed by the Manager. Must have a valid Cglifor ia driver 's license before assignment to job. Mush be able to write legibly and maintain a neat, glean appearance at all times . Start $3o59 6 months 3o76 1 year 3*88 18 months 4oO3 2 years 4el7 HELPER Must have sufficient knowledge and adaptab�lity to understand and carry out duties as assigned; must be semi-skilled laborer, or equivalent with past experience a� such, capable of handling ordinary tools safely in accordance with lYi$tricta safety-rules . Assist skilled workmen or apprentice or work undet their direction at various classes of work which may be assigned in any location and other duties prescribed by District Manager. Must have a valid California Driver 's license before assignment to job, Hourly rate $3.84 Effective May 1, 1970 -1 law HELPER - TEMPuAARY (A "Helper-Temporary" is a student htred during vacations and others hired for a limited period of time fpr seasonal or emergency work. Employees under this cla$sification shall only be hired as needed to supplement the regulstx work force and shall normally be assigned only such work as falls within the Helper def init ion. Must have a valid California Driver 's licens e before assignment to job.) Hourly Rate $3v24 Effective May 1, 1970 CUSTOMER SERVICES CLERK TRAINEE An employee not required to have prior experience and is a trainee to a Customer Services Clerk, a more advanced clerical position. In the bourse of traintr�g �nay be assigned to perform any and all off ice functions , learn procedurest including the operation of various of f ice machines . Assignment may include customer contacts in ,perpon anti/or by telephone and running office errands to outside locations . Must be able to type with proficiency prior to advancement to the next higher classifica- tion. CUSTOMER SERVICES CLERK An employee who has either progressed throm gh the steps of the trainee classification or has had prior cletf.cal experience and has demonstrated to the District the knowledge, skill and adagt- ability to perform any and all clerical functions such as : 1. Billing procedures 2. Customer contacts in person ,and by phone 3. Payroll 4. Operating all office machines 5. Using base radio for both receiving and dispatching calls 6. Mail, cashiering, bank deposits and general, typing Start $2*60 3 months 2*80 1 year 3e01 _12_ EXHIBI "B" ADDITIONAL WORK CONDITIONS The District reserves the right to temporarily work any classified electric employee on work in connection with its water system, or any classified wader employee on temporary work on the electric system, without change in the rate of pay' or classification pf such employee , The District is to be the Judge as to the competency and fitness of prospective employees and of the satisfactory perfo ances of work by any employee .
