That in order to establish a standard policy and effi- :ient procedure for the purchase of supplies and equipment at the .,.east possible cost commensurate with quality needed, a purchas- , .ng system and policy is hereby adopted. 2. On or before May 1st of each year all officers, agencies and departments of this district shall prepare and submit to the General � Manager hereof an estimate of required supplies and equipment for the ensuing 12 months' period, or for such adds Cional time as the General Manag s,er may direct. I. PURPOSES: The purpose of these economicalreau lations is adminl8trationto Facilitate—tTie efficient, orderly 3f the purchasing of supplies and equipment. II. DEFINITIONS: The following terms used hereunder shall be con s t ru e aT76T5w s : 1. DISTRICT The Truckee Public Utility District, i.ncluding an and all departments or agencies thereof. y 2. LOWEST RESPONSIBLE BIDDER - In addition to price, the following factors shall also be considered: (a) The ability, capacity and skill of the bidder to perform the contract or to provide the supplies and equipment required; (b) Whether the bidder has the facilities to perform she contract or provide said supplies and equipment promptly, on time and without delay or interference* (c) The character, integrity, reputation, judgment, experience and efficiency of the bidder; (d) The bidder' s record of performance of previous and existing contracts; compliance conditionswith laws attachedp toc thee bid thereto, any end the number and scope of (e) The quality, availability and adaptability of sup )lies and equipment specified and the ability of the bidder to provide future maintenance; 3. RESPONSIBLE BID - An offer, submitted by a responsible Bidder to furnish or sell supplies and equipment in conf ormity .with the specif ications, delivery terms and other provisions applicable. 4. PURCHASES - Includes leases or rentals of supplies acq uires �quipment, as well as transactions by which the Districtquires ,)wnerFhip. 5. SUPPLIES AND EQUIPMENT - Includes any and all articles, Lhings or personal property furnished to or used by the District, !:)r any agency or department thereof. III. NECESSITY OF BID ADVERTISING AND CONTRACT LETTING: 1. Pursuant to the provisions of Section 16544 of the -1- Public Utilities Code of the State of Calif ornia, articles may be purchased without the necessity °na�volvedni n fthe bids purchaaeeatin contracts therefor where the amount any one time does not exceed $2,000-00. 2. Where the cost of an article for Board shall�advertis tract nas been entered into exceeds $1,000-00, for sealed bids for furnishing such articles. 3. Though the amount involved in any purchase be below the limit specified in Paragraph 1 above, the Board of Directors of said District may, and the General Manager thereof shall, apon direction of the Board, nevertheless advertise for bids and purchase supplies and equipment hereunder in accordance with the provisions and bidding pro cedures herein set forth and referred to where, in the opinion of said Board, such procedure will be in the best interests and for the benefit of said District. IV. ` ADVERTISEMENT FOR BIDS: 1. Subject to the provisionsl if Division seale of the d Utilities Code, the Board shall annua y yids for furnishing the District terials with and allgoods,otherm erchandises andQres, subsistence, printing, � advertising. 2. Advertisement for bids hereunder shall be made pursu- ant to Government Code Section 6062, to-wit: ten (10) days. 3. Publication of call for bids or proposals hereunder shall be in a newspaper of general circulation in the county ahereir, the district, or the greater part thereof, is situated. V. BIDS: 1. All bids shall be upon a schedule prepared by the �lerk of the District, showing the articles needed by the Distric end its departments and agencies, and stating separately the price of each article to be fur ishedo 2. Any person may bid upon any article separately. VI, NOTICES OF PROPOSALS OR CALLS FOR BIDS: FAM le Notices of proposals or calls for bids for furnishing articles, supplies and equipment shall describe the same- gener- �lly, shall state that the conditions and bid schedule may be pound at the office of the District Clerk, and that the articles, supplies and equipment shall be delivered at such times, in such uantities and in such manner as the Board of Directors may Jesignatee 2. VJJ* PROPOSAL OR BID SECURITY: 11 All proposals or bids shall be accompanied with a yertificate of deposit or certified check equal to ten per cent (10%) of the amount of the proposal or bid, drawn on e solvent yank within the District or the county in which the District is Located, payable at sight to the order of the Clerk of the district. -2- VIII. IX. BID FORMS AND RELATED DOCUMENTS* The Clerk of the District shall furnish printed blanks and forms for all proposals, bids, contracts and bands. X. BID OPENING: 1. Sealed bids shall be submitted to the District and shall be identified as bids on the envelope. 2. All bids shall be opened by the Board at the hour and place stated in the advertisement therefor, in the presence of all bidders who attend, and the bidders may inspect the bids. XI: ACCEPTANCE AND REJECTION: 1. The Board may accept or rej ect any or all bids, or :nay accept or reject part of a bid, preference being given to the lowest responsible bidder. 2. The award as to each article shall in all cases be Wade to the lowest bidder for such article. XII: TIME OF AWARD: Action by the Board in acceptance or refec(10) daystion fromof bids, 3r parts thereof, shall be had within otherwise in said ead- date of opening thereof, unless specified Jertisement, and no bid may be withdrawn during such period. XIII: PRICE: All supplies and equipment furnished the District, or its departments or a gencies shall be furnished at a price no ;rester than is speci fied in the bid accepted by the Board. XIV. AWARD — BOND: W--� 1. All contracts shall be made with the lowest responsi- )le bidder,, who shall provide bonds with sufficient sureties to '_assure the faithful performance if said contract. 2. The amount of such bond shall be not less than that specified by the Board of Directors, or the laws applicable Thereto, whichever is higher. XV. AUTHORIZATIONS: No officer or employee of the District shall order any articles, supplies or equipment, or make any publication not authorized by the Board of Directors of said District or by Division 7 of the Public Utilities Code of the State of Califor i XVIo SEVERABILITY _AND APPLICATION: 1. If any provision of these Rules and Regulations, the 3_ Laws pursuant to which the same are adapted$for or the applicatheldionin -hereof to any person or circumstance is any reason ialid or unconstitutional, such decision shal not affect the ,7emainder of the provisions hereof or thereof.l 2.
