HomeMy WebLinkAboutRES 1978-64 - Board AS It RESOLUTION NO 7864 of TRU(I"KEE DONNER PUBLIC UTILITY DISTRICT' APPROVING SPECIFICATIONS AND CALLING FOR BIDS ON THE LEASE OF A 1 .9 ACRE PARCEL OF DISTRICT LAND • WHEREAS on February 21 , 1978, the Board of Directors of the Truckee Donner Public Utility District adopted Resolution No. 7810 clarifying District policy regarding the lease of District land; and, WHEREAS, Resolution 7847 was adopted making all appropriate find- ings and declaring said parcel unnecessary for Dist rust use; and WHEREAS on October I ' 0, 1978, the Board adop ted Resolution No. 7851 setting forth minimum bid requirements for the 1 .9 acre pa rcel located on the corner of Highway 89 and Donner Pass Road more sp ecif- ically described as follows: A portion of the Northeast one-quarter of Section 16 Township I' North, Range 16 East, M.D.M. known as Nevada County Assessor' s Parcel. No. 18-570-10, NEW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District, as follows : The Board of Directors does hereby approve the Q,uest ionna i re for Bidders, attached hereto as Exhibit "A," and Conditions of Lease, attached hereto as Exhibit 11B.11 2. Submit with your bid current financial statements for all party es. 6* Do you agree to submit all site plans of any proposed installationseleated views of any proposed buil(Nngs and a development schedule to the District prior to any work and acknowledge that all proposals for any instaRations and developrnent are subject to approval by the Truckee-Donner Pub lic Utility District, Yes No EXHIBIT "All Ai k • .M i RM CONDffIONS OF LE ASE The Board of Directors of the Truckee-Donner Public Utilit y District s ha ll award the lease in an ordinance, and said lease shall be conditioned upon the following: 1* A minimum monthly rent of TWO THOUSAND FOUR HUNDRED AND N01100 ( 2,400.00) DOLLARS0 2* Cost of living increases every five (5) years. 3* Term of thirty (30) years 44. The District shall retain control over the use of the parcel and the desigii of the structures to be constructed thereon/for the term of the lease and an 4- y extensions thereto; 5* The lessee shall reimburse the District for all costs expended in connection with the lease of the parcel including legal, engineering, appraisal, advertising and supervisory costs; 6,o The District shall provide and the lessee shall pay for a title policy evidencing District ownership of the policy; 7e The lessee shall be responsible for the taxes and assessments to be levied on the parcels I 8. Lessee shaIl indemnify the District so that the District shall not be liable for any damage or liability of any kind or for any injury to or death of persons or damage to property of lessee or any other person during the term of the lease, from any cause whatsoever, by reason of the use, occupancy and enjoyment of the parcel by the lessee or any person thereon or holding under said lessee, and that lessee will indemnify and save harmless the District from all liability whatsoever, on account of any such real or claimed damage or injury and from all liens, claims and demands arising out of the use of the parcel and its facilities, or any repairs or alterations which the lessee may make upon the petrcel- Lessee will carry and maintain, at its sole cost and expense, bodily- inj ury liability insurance with limits of not less than $500,000.00 per person and $1t000,000-00 per ocurrence insuring against any and all liability of the 60 insured with respect to said premises or arising out of the., maintenance, iuse or occupancy thereof, and property damage liability insurance with a limit of not less than $1 49 00.,000.00 per accident or occurrence,, All such bodily injury liability insurance and property damage liability insurance shaIl specifically insure the performance by lessee of the indemnity agreement as to liability for injury njury to or death of persons and injury or damage to property as set forth above. EXHIBIT "B" 1W "VIA % AMc fA* Noel, 40 INVITATION TO BID NOTICE I5 HEREBY GIVEN to prospective bidders that sealed bids will be received by the Truckee-Donner Public Utility District, Donner Pass Road, Truckee, California, until , 1978, at P.M., for the lease of a l.9 acre parcel located on the corner of Highway 89 and Donner Pass Road, which parcel has been declared unnecessary for District use. Prospective bidders are asked to contact the Truckee-Donner Public Utility District office, Post Office Box 309t Truckee, California 95734 (telephone 916-587-3896) for a description of the parcel and conditions of the lease. All bidders must submit a certificate of deposit, certified check or bid bond in a sum equal to ONE THOUSAND DOLLARS ($1,000.00),, Said deposit, check, or bond shall be forfeited in the event that the bidder is awarded the lease and fails to accept the same within sixty (60) days. All bidders must submit a completed and signed "Questionnaire for Bidders" supplied by the District. The minimum bid will be $2t4OO.00 per month.
