HomeMy WebLinkAboutRES 1977-24 - Board RESOLUTION 7724 APPROVING THE WATER SOURCE AUGMENTATION AND ELIMINATION OF SYSTEM LOSSES , PROJECT 77-1 WHEREAS : The project has been under discussion by the Board of Directors at various public meetings beginning in February of 1977 ; and WHEREAS : The Board of Directors requested that the District staff conduct an initial study as to the Environmental Impacts of the proposed project in July 1977 ; and WHEREAS : The staff of the Truckee Donner Public Utility District conducted an initial study and prepared an Environmental Assessment on Project 77-1; and WHEREAS : The Board of Directors in open session discussed the initial study, Environmental Assessment, public comment and there upon resolved that a Negative Declaration be filed with the Clerk of Nevada County; and WHEREAS : The Negative Declaration was duly filed with the County Clerk and posted in public places within the Truckee Donner Public Utility District; and WHEREAS : The statutory waiting period has passed without objection to the project and it is now appropriate f or the Board of Directors to consider the approval or disapproval of the project based on the findings , public input and personal knowledge. NOW THEREFORE BE IT RESOLVED: 1. That the water source augmentation 'and elimination of system losses , Project 77-1 as described in the Environmental Assessment dated August 1, 1977 and the Negative Declaration filed with the Nevada County Clerk August 4, 1977 is hereby approved. 2. The Project will also eliminate the losses currently being experienced from the Deerfield Main. The Project will provide an additional margin of safety when comparing current demand with supply potential. Operation efficiencies will also result from the Project. On about July 12 Y , 1977, Dart provided the District with completed Plans, specifications . P , p at�.ons and cost estimates for the in-s to I l at ion of a twelve (12) inch d'a •diameter water main to be installed in a common trench with Pacif ic Telephone and Telegraph Company' s underground conduit g system along State Highway 267 from Riverfront Street across c oss the Truckee River to the intersection of South River Street West, 2 . The District's consulting engineerreviewed, recommended revisions as appro riate and appropriate., approved of such plans and specifications on about July 25, 1977 . The ap- . proved plans and specifications shall be the contract doc- uments for said installation, subject ect only to • � y such written changes as may be requested b Dart g y and recommended by the District 's engineer and approved b pp y the District 's manager. 3 . Dart shall cause. the installation o to be constructed in accordance with the contract documents , 4 . Upon completion, D P , art shall convey the installation to the District. The District shall accept p said conveyance and unless Dart elects to satisfy its remaining obligatio ns under the 1970 Agreement and the 1973 Sup plemental Agreement f t � J by means of any water source (s) located south of the Truckee River, the District shall repay Dart the full cost of the engineering and construction of the installation by def erred payments , without interest. . If Dart elects to satisfy its obligation by means of such sources, the District shall. not be required to repay any amount to Dart. 5 . The repayment, if any, to be made to Dart shall. be .made by three (3) equal annual installments. The first installment shall be due on the last dayof the fiscal year y following the fiscal year in which it is determined with certainty that Dart will not resort to any water source (s) located south of the Truckee River to satisfyits remaining g obligations under the 1970 Agreement and the 197 3 Su le-" g pp mental Agreement. 6. As security for the payments to be made to Dart the District shall provide Dart with a first priority deed p �' of trust in an amount equal to the total amount to be paid to Dart covering the property described on Exhibit "A" attached hereto. Dart shall reconveY to the District the lands subject to Deed of Trust when either of the -following conditions occurs.. a. Dart elects to satisfy its obligation under the 1970 Agreement and the 1973 Supplemental Agreement by means of any water source.(s) located south of the Truckee River; or s b.
