RESOLUTION DECLARING SURPLUS IN
WEST RIVER STREET ASSESSMENT DISTRICT,
TRUCKEE-DONNER PUBLIC UTILITY DISTRICT,
NEVADA COUNTY, CALIFORNIA
WHEREAS, on the 29th day of August, 1974, the Board of
Directors of the Truckee-Do'nner Public Utility District, Nevada
County, California, adopted its Resolution of Intention, as amended,
for public improvements in West River Street Assessment District,
and therein provided that any surplus in the improvement fund for
. said assessment district, after completion of improvements and pay-
ment of all claims from the improvement fund, would be applied in
accordance with Section 10427 of the Streets and Highways Code of
the State of California; and
WHEREAS, subsequent thereto the Board of Directors of the
Truckee-Donner Public Utility District adopted a policy providing
for the processing of connections to the water system constructed in
the West River Street Assessment District, which policy includes the
distribution of surplus funds in the assessment district imp rovement
f and caused by the accrual of connection charges; and
WHEREAS, connections have been. made to the water system
which have generated the sum of $4,158. 96,
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
Truckee-Donner Public Utility District as follows:
l.. That the' Board of Directors of the Public Utility
District hereby finds that the balance of $4 ,158. 96 is on hand in
the improvement fund for West River Street Assessment District and
hereby declares that said -amount is surplus.
2. The surplus shall be disbursed in accordance with the
provisions of Section 10427 of the Streets and Highways Code of
the State of California, as, provided in the original Resolution of
Intention, as amended, and more specifically said amount shall be
applied as a credit upon the assessments levied in the assessment
district as set forth in the policy document hereinabove referred to.
3. In accordance with said provisions, the current owners
of any properties upon which the assessments have been paid in full
shall receive a cash payment.
4. The Treasurer of the Public Utility District is author-
ized and directed to transmit a certified copy of this resolution
to the Auditor/Controller of the County of Nevada with instructions
to make such cash payments and to apply credits against the assess-
ments where appropriate. The amounts to be credited against assess-
ments or to be paid in cash shall be as set forth by Dan Cook of
Cook & Associates, the Engineer of work for West River Street
Assessment District.

of the Truckee-Donner Public Utility District duly called and held
in said District on the day of , 19771 by the fol-
