OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
FIXING AND PLACING ELECTRIC AND WATER STANDBY
CHARGES ON DISTRICT TAX ROLL FOR COLLECTION BY THE
COUNTIES OF PLACER AND NEVADA
WHEREAS on February 18, 1975, the Board of Directors of the Truckee
Donner Public Utility District duly adopted Ordinance No. 7501 fixing elec-
tric and water standby charges on lands within the District boundaries and
providing a means for collection thereof; and.
WHEREAS, on August 16, 1982, the Board adopted Resolution No. 8240
amending Ordinance 7501 to include Placer as well as Nevada County; and
WHEREAS, on May 21, 1984 the Board of Directors of the
Truckee Donner Public Utility District adopted Resolution No. 8432, im-
plementing and fixing electric and water standby charges pursuant to Ordi-
nance No. 71501 for the fiscal year 1984-85; and

WHEREAS, the District has now determined the lands affected thereby
and the charges to be assessed, levied and collected on the lands and par-
cels;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee
Donner Public Utility District as follows:
1. That the Board of Supervisors of the County of Placer,
State of California, and the County of Nevada, State
of California, levy the standby charges against the
parcels and owners of record listed on the computer
itemization of unimproved parcels, kept and in-
r. in the Engineering Department of the District, and
made a part hereof by roference, and that the County
Auditors and Tax Collectors be instructed to levy and
collect said charges in the same manner as County
taxes as by law and in said Ordinance provided. Upon
completion and correction of the current list through
June 30, 1983, a copy will be forwarded to the Auditor
Controller of each County.
2. That the Clerk of the District be directed to forward
certified copies of the Resolution to the Board of
Supervisors and County Auditor of the County of Placer,
and the Board of Supervisor's and County Auditbr of the
County of Nevada.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner
Public Utility District at a meeting held within said District on the
21st day of-, May 1984, by the following roll call vote:
AYES: Cooley, Corbett, Hamilton and Duffy.
NOES: None.
ABSENT: Maass.

ENTERING INTO AN AGREEMENT WITH THE STATE
OF CALIFORNIA, DEPARTMENT OF GENERAL SERVICES,
COMMUNICATIONS DIVI:.SION, FOR SERVICE
WHEREAS, the State of California, Department of General Services,
Conmaunicat;iGa,5 division, is authorized under State Government Code Sec-
tion 14624 to render service to local "political subdivisions; and

WHEREAS, the Truckee Donner Public Utility District is desirous of
having the Department of General Services provide maintenance and repair
service to the District's radio equipment; and
. WHEREAS, the current agreement with the State of- California, Depart-
ment of General Services, Communications Division, expires on June 30,
1984;
NOW, THEREFORE, BE IT RESOLVED by the Beard of Directors of the Truckee
Donner Public Utility District as follows:
That the President of the Truckee Donner Public Utility District
is hereby authorized to enter into an agreement with the Depart-

ment of General Services ,for the repair and maintenance of the
District's radio equipment from July 1, 1984 to June 30, 1985.
A copy of the agreement is attached hereto and incorporated here-
in by reference.

AGREEMENT
THIS AGREEMENT, made and entered into this 1st day of July 1984, by and between
the State of California, Department of General Services, Office of
Telecommunications; acting by and through the Chief, Office of Telecommuni-
i:
-cations hereinafter called STATE;, and tale Truckee Donner Public Utility
District hereinafter called AGENCY.
WITNESSETH:

WHEREAS STATE is authorized under State Government Code Section '14624 to render

service to local political subdivisions* k
WHEREAS AGENCY is desirous of having STATE provide maintenance and repair
service to AGENCY P radio equipment listed on the attachment marked "Exhibit A"
and made a part of this agreement by reference*
NOW, THEREFORE, the parties do hereby agree as f ollows:
I. STATE agrees to provide radio maintenance and repair service to AGENCY on
t. a mutually agreeable schedule. In the event of a conflict between STATE

and AGENCY service requirements, service to STATE equipment will have
priority.
2. AGENCY agrees to provide STATE technician's with instruction manuals and
schematics unique to its system equipment.
3. AGENCY agrees to be responsible for establishing g p a method for verifying
charges made and invoiced by STATE. w

4. Equipment repairs required due to accidents or acts of nature, equipment
ui ment
modification, installation, and other work not within the category of
normal maintenence will be performed by STATE upon request of AGENCY. In
such cases, a separate written authorization using Form COM-207 will be
required for each job.
5. STATE, in addition to the radio maintenance services described above, is
Willing to provide radio system engineering services to AGENCY.
Engineering services include systems and equipment design engineering,

specification preparation and review, and equipment evaluation and
testing. Engineering services will be provided on an individual basis
upon Written request by- AGENCY. A written estimate of costs for such
engineering services will be provided by STATE to AGENCY prior to
proceeding with any work.

6. Costs for services to be provided by STATE shall be fully reimbursed by
AGENCY at an hourly rate computed in accordance with State Administrative
Manual Section 8755.1. AGENCY agrees to- pay to the STATE, upon receipt t of

an invoice, STATE'S current rate of $59.00* per hour for radio maintenance
service, including repair parts, for services as are actually rendered.
Travel to and from site of service will be at the above hourly rate.
Emergency overtime calls for repair services after normal STATE working
hours and on official STATE holidays will be at the above hourly rate with
a minimum four—hour charge• Invoices will be presented monthly as
necessary.
7. AGENCY is required to schedule invoices for payment to the STATE no later
than 15 days after receipt of invoice. If errors are found in the invoice
or AGENCY disputes invoice charges or services rendered, STATE is to be
notified immediately. Partial payment of an invoice without STATE'S
approval is not allowed. Failure to comply with STATE'S payment policy as
outlined above may result in cancellation of this agreement.
8. A'r-yency agrees to indemnify, defend and save harmless the STATE, its
officers, agents and employees from any and all claims and losses accruing
or resulting in connection with the performance of this agreement, and
from, any and all claims and losses accruing or resulting to any person,
f i A►n or corporation who may be injured or damaged by the AGENCY in the
performance of this agreement.
9. This agreement commences July 1 , 1984 and terminates June 30, 1985 subject
to the right of either party hereto to terminate this agreement at any
time during the term hereof by giving the- other party 60 days written
notice of such termination. "
