HomeMy WebLinkAboutRES 1984-30 - Board E-2-1 POLICY ITEM: DEFINITIONS Date issued: 5.�21I84 Reference: _ _]&psolution___NQ. 84*10 Date effective: 5/21/84 Truckee Donner Public Utility District POLICY STATEMENT 2.1 When used in these policies and in the District's rules, regulations and rate schedules, the following terms shall have the meanings defined be- low: Accessible - Not permanently closed in by the structure or finish of the building; kept free of physical encumbrances, capable of being checked for reading, renewal, inspection or testing without the assistance of the cus- tomer, Agent - An authorized representative of the District. Applicant - A person, firm, association, corporation, or governmental agency making application for electrical service. Application - A written request on the proper District form from an applicant for electrical service. (As distinquished from an inquiry regarding avail- ability or charges for such service,) Average month - Thirty (30) days. Billing period - An average month. Board - The lawfully elected or appointed Board of Directors for the Truckee aonner Public Utility Districts Collection problem - Any customer who is sent a final notice concerning their bill two (2) or more times in 12 contiguous months, or whose service is dis- continued for non-payment of -a bill or deposit. Connection fee - The charge made by the District to establish a new service including, but not limited to, the costs of material and labor to provide the appropriate service. -m Consumer - The person, firm, association, corporation, or governmental agency which actually uses electricity provided by the District. Customer - The person, firm, association, corporation, or 'governmental agency in whose name service is rendered as evidenced by the signature on the appli- cation or contract for that service, or in the absence of a signed document, as evidenced by the receipt and payment of bills regularly issued in his name regardless of the identity of the consumer. Fraud - An intentional effort to thwart or impede the District in its day- to-day activities concerning its legal obligations to its customers, I Kilovolt - A unit of potential dif ference equal to 1,000 volts. Kilowatt - 11000 watts. i i Kilowatt hour - A unit of work or energy equal to that expended by one kilo- watt in one hour. Line extension - A lengthening of the District's electrical distribution lines and related facilities beyond the existing service facilities. Metering, unauthorized - Any unauthorized attempt to control or alter the registration of the District's meter. Metered service - Electric service in measured quantities charged for on metered rates. Meter tampering - The effort of any unauthorized person, whether qualified or not, to affect or influence the service or accuracy of the District's meter or meters in any manner. (i.e. electric, electronic, magnetic, mech- anical) Multiple service - Electrical service provided to a single domestic or com- mercial service connection which is used by more customers than normally as- sociated with such service, e.g. , duplexes, mobile home parks, apartments, motels, office complexes, condominiums? townhouses, etc. Permanent service - Electrical service provided on a continuing and estab- lished basis. The actual use of electricity may be continuous, intermittent, or seasonal in nature. Person - Any individual, partnership, corporation, governmental agency, or other organization operating as a single business entity. Premises - A ,lot or parcel of improved or unimproved real property under one ownership; provided, however, that any separate structure under one roof shall be deemed individual and separate premises, at the District's discretion. } Public Use - Electrical service provided to a municipality or other public entity. Reasonably -- Not extreme or excessive; standard utility practice. The Dis- trict shall be the sole judge of this interpretation. 3.1(B) Policies - copies of these policies, service area maps, and forms of contracts and applications relative to electric service; 3.1(C) Rates - copies of the rates and fees for electric., service. 3.2 Rates - Upon request, the District will inform each applicant for service of the applicable rate schedules. 3.2 (A) In the event that optional rates are available, those rates and the conditions under which they apply shall be set forth in the schedules; 3.2(B) Upon application for service or upon request, the applicant or cus- tomer shall choose the available rate schedule which he would like applied to his service; 3.2 (C) When a business is operated in conjunction with a family residence or domestic service and the electric service for each purpose can- not be readily separated, the rate schedule shall be determined as follows: { If less than 10 0 of the estimated consumption is utilized for bus- iness purposes, the domestic rate shall apply; conversely, if over 10% of the estimated consumption is used for business purposes, the commercial rate shall apply. 3.2 (D) The Distric t, reserves the right to make the final determination of the applicable rate schedule. 3.3 Requests for information 3.3 (A) Upon request, a customer will receive a statement of such customer's monthly KWH consumption for the prior twelve month period. There is . no charge for this service. : 3.3(B) Requests for information may be made in person at the District o f- f ice, by phone or by mail. l E-4-1 POLICY ITEM: OWNERSHIP OF FACILITIES AND RIGHT OF ACCESS ELECTRIC RULE NO. 4 Date issued: 5L21 84 Reference: Resolution No. 84-30, Date effective: 5 Z21184 Truckee Donner Public Utility District POLICY STATEM ENT 4.1 All facilities installed on a customer's premises, including but not limit- ed to conductors, transformers, poles meters, etc. , which are furnished by the 3 District in order to render electric service, shall remain the sole property of the District. The District shall have the right of access to the property of the District. The District shall have the right of access to the customer's premises without payment of any charge or rent, therefore at all reasonable hours for any purpose related to the furnishing of electric service, including but not limited to meter reading, testing, inspection, construction, maintenance, and repair of facilities. Upon termination of access to the customer's premises, the District shall remove its facilities installed thereon. The customer shall provide appro- priate easements as required. 4.2 Customer responsibility for District facilities - the customer shall exer- cise reasonable care to prevent -facilities of the District installed on his pre- mises from being damaged or destroyed and shall refrain from tampering with such facilities, and if any defect therein is discovered by the customer he shall promptly notify the District thereof. 4.3 Customer re sponsibilit for customer facilities - the customer shall, at his sole risk and expense, furnish, install, inspect and keep in good and safe condition all electrical facilities required for receiving electric energy from the lines of the District, regardless of the location of the transformers, meters, or other equipment of the District, and for utilizing such energy, including all necessary protective devices and suitable housing thereof, and the customer shall be solely responsible for the transmission and delivery of all electrical energy over or through customer's wires and equipment, and the District shall not be responsible for any loss or damage occasioned thereby. Otherwise, it will apportion its supply in the man- ner that appears most equitable under the circumstances then prevail- ing, with due regard to public health and safety. Customer may also be required to obtain approval of service changes from Nevada/Placer County Building Department artment or the State of California. 8.3 Special cases - When in the opinion of the District, an application reveals that pan ique or special curcumstance s exist for the proposed elec- tric service, the District may, at its discretion require that the appli- cant enter into a separate agreement for the provision of such service. E 8.4 Fraud - Any customer determined by the District's management and/or Board to defraud or attempt to defraud the District shall automatically X � E-8-2 forfeit all application and connection fees. Unless otherwise reordered, service shall be discontinued where the customer cannot reconnect and shall remain discontinued until customer reapplies for service. Further- more, all services in this customer's name shall be discontinued and all application and connection fees and all deposits shall be forfeited. 8 -4 (A) Any customer who is a renter of his residence, place of business, or any other location that is served by the District and is determined by the Dis- trict to defraud or attempt to defraud the District shall automatically forfeit any and all application fees and any deposits held by the District. B) underground service facilities at secondary voltage, 480 volts or r less: In areas supplied by the District's overhead facilities, where the District's distribution pole line is located on a street, highway, lane, alley,, or private easement .immediately contig- uous and at a distance not t4 exceed 60 feet to the customer's premises the District will, in accordance with the established service connection charges, furnish and install a service line from its pole line to the customer's service. Service connec- tions of District-installed cable shall be made by District per- sonnel. 1) The underground facilities shall be furnished b the customer g y at his expense and shall include sufficient underground con- duit to 'reach from a place on the building designated by4,Dis- trict personnel to a place on the pole also designated by District personnel E-10-2 10.2 The District is not obligated to serve any customer who fails to implement and complete all of the District's requirements for service., A) The electric meter shall not be less than 6 feet nor more than 8 feet from final grade or surface., B) Any service requiring a transformer rated meter, the customer shall provide in addition to the appropriate meter socket an approved box to house 'current and/or potential transformers. The meter socket and current transformer box may be located in separate boxes cr may be housed in one box. (See FUSER stan- dards) C) Any service disconnect switch used on customer's facilities shall be Underwriter's Laboratory approved for service entrances. Consult local inspection authorities for required service switch or circuit breaker size. D) Consult local inspection authoritires for required grounding as to conductor size and type. 1) Customer's ground and District supplied neutral must connect at some point in the customer's service so as to prevent any possibility of a potential or voltage between the neutral and the ground., E) If a meter becomes inaccessible for any reason, the customer shall promptly move the meter socket and/or service to an accessible location as required by the District. F) If a meter socket and/or electric service comes into disrepair for any reason, the customer shall promptly repair the socket and/or service to applicable standards or codes. The District will as- sist by disconnbcting the District's= cables so that work may pro- ceed and will connect to customer's wires, after work is complet- ed and any necessary inspections are made and tagged by local in- spection authorities. 10.3 The District will not connect to any one building more than one service for each voltage classification, either overhead or underground, except for the District's operating convenience or where the customer is required by law to install emergency lighting facilit-ies. In no instance shall the meter be enclosed. 5) If meter is located above any deck or porch, said deck or porch must be readily accessible from the ground, by way of an outdoor stairway. A meter will not be installed in any service above a deck or porch unless said deck or porch is fully constructed. 6) If for any reason a meter becomes higher than approved by the Dis- trict, the customer shall move the service and/or meter socket to a location approved by District personnel. In the event the ser— a vice cannot be moved, then the customer shall construct and keep in good repair a walkway complete with railing to the meter loca- tion. B) No splices are permitted within service entrance conduits, whether over- head or underground. C) All connections made by the customer at the meter base must be tight! D) Consult local inspection authorities for size and typ e of conductors. Conductors shall be supplied and installed by the customer with the exception of underground service which is supplied and installed by the District. 1) Minimum requirement for conductor insulation -.1is THW 750 C, thermo- plastic. E) Consult local inspection authorities for size and type of conduit. Min- imum size acceptable to the District of underground conduit shall be 2 1/2". All oil releases are to be con- sidered PCB contaminants unless determined otherwise by the appropriate Supervisor. 11.2 Definitions i 11.2(A) NIOSH National Institute for Occupational Safety and Health. 11.2 (B) PCB Polychlorinated biphenyls. Organic chemical sub- stance, most often synthetically manufactured, which is used as an additive to oil in some electrical equipment. 11.3 Notification - The person discovering the release or spill insures i that the General Manager is notified. Except as otherwise specifically provided herein, five days written notice will be given before service is discontinued. 19. 1(A) Non-payment of bills - the District may discontinue or refuse ser- vice if a customer has not paid his bills for electric service, or has not paid reconnection charges, or has not made cash deposit as required by the District in accordance with its policies provided, however, that the District must give the customer seven days prior written notice and otherwise comply with Public Utilities Code Sec- tions 16482 and 16483. 19. 1 (B) Unsafe or illegal, apparatus - the District may discontinue or refuse service if any part of customer's wiring or equipment or use thereof, is either unsafe or in violation of law, until such apparatus is placed in a safe condition or the violation remedied. 19.1(C) Service detrimental to other customers - the District may discon- tinue or refuse service if, in District's judgment, the operation of customer's equipment is or will be detrimental to the service of other customers. 19.1(D) Fraud - the District may discontinue service without notice or re- fuse service if the customer's actions or the condition of his pre- mises is such as to indicate his intent to defraud the District. 19. 1(E) Failure to establish or re-establish credit - the District may dis- continue or refuse service if customer fails to establish credit in accordance with the rules and regulations. 19.1(F) Discontinuance of service - District may discontinue or refuse ser- vice if customer does not comply with District's rules and regula- tions, or for non-payment of bills. The District will also sell power and energy to the qualifying facility as it may require. The District will sell the qualifying facility its needs over and above its generating capabilities or, at the qua l ifying f ac i l ity's op tion, will purchase 100% of its generation output and sell to the qualifying fac- ility 100% of its needs. 23.2 The District will base "avoided costs" on that portion of its wholesale power cost which, by virtue of the purchase from the qualifying facility, it now avoids. 23.3 Energy cost avoidance will equal the wholesale cost of energy on a one- for-one basis.. 23.4 Firm capacity cost avoidance will equal the wholesale cost of firm cap- acity on a one-for-one basis for all capacity the qualifying facility can pro- vide on an equally firm basis as the District's wholesale power supplier. Non-firm or intermittent capacity will not qualify for payment. 23.5 Power and energy sales to the qualifying facility shall be made at standard rates. 23.6 PURPA provides that other Districts shall not subsidize the qualifying facility. Thus, all costs including engineering, construction, material and related expenses are to be paid by the small power producers and cogenerators.. 23.7 The District is to be held harmless from all acts or omissions on the part of the -qualifying facility. The qualifying facility will be required to carry adequate insurance and will be required to reimburse the District for its additional insurance premiums which may be caused by the connection of the qual- ifying facility. 23-.8 The' PURPA- regulations also mandate that service to other Districts shall not be degraded because of the presence or connection of the qualifying facil- ity. The qualifying facility shall construct, operate and maintain its facil- ities or cause them to be constructed, operated and maintained, in a manner conforming to all existing safety codes, regulations and best operating prac- tices.
