RESOLUTION NO. 84 29
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
ESTABLISHING DISTRICT POLICY REGARDING PRO-
CEDURES FOR WATER SERVICE APPLICATIONS
AND THE PROCESSING OF SAME
'
WHEREAS, the public interest is to be served by a consistent, concise
and understandable proceeding for processing. water service applications; and
WHEREAS., "'there is- a specific need for a policy that cannot be misun-
derstood by developers creating new projects_ withinthe Truckee Donner Pub-
lic Utility District service area;
NOW, THEREFORE BE IT RESOLVED by the Board of Directors of the Truckee
Donner Public Utility District that the policy regarding procedures for water
service applications as set forth in Exhibit "A" attached hereto is hereby ef-
fective as r,)f..the date of adoption of this resolution.
BE IT FURTHER RESOLVED that the General Manager, shall develop operation-
al methods for st&f'L use to implement the intent of this policy which shall be
effective as of the date of adoption.
FURTHER, all previous policies relating to water service applications
and their processing are hereby rescinded.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner
Public U t*lity District at a regular meeting held within said District on
the ;5p, day of May 1984, by the following roll call
vote:
AYES: Cooley, Corbett, Hamilton and Duffy,
NOES: None.
ABSENT: Maass.

29, 1 Every application for water service shall be classified by the nature
of the service requested in accordance with the Water Project Review
Guidelines - Attachment No. 1.
29.2 Every classified application for water service shall be processed in
accordance with the specific activities as dictated by the Water Pro-
ject Review Guidelines - Attachment No. 1,
29.3 The General Manager shall develop operational methods for staff use
to implement the intent of this policy which shall be effective as
of the date of adoption.

Project conditions
In order to provide water service as requested by the applicant, it is
necessary for the District's existing facilities to be modified,
The District will design and construct the modifications as outlined under
"Water System Modifications," according to its Rules and Regulations for
Water Service. The District has full discretion to design, plan or modify
the water system as necessary,.
The applicant agrees to place a deposit with the District equal to the es-
timated construction, design and administrative costs. Further, the appli-
cant acknowledges that construction costs may exceed or be less than shown.
The applicant will be billed or refunded accordingly. If billed, the appli-
cant will pay the excess costs within 30 days.
Prior to the commencement of construction, the applicant will provide to
the District appropriate easements and rights of way for access to the
water facilities, as designated by the District. The applicant acknow-
ledges that it may be necessary for him to obtain easements and/or permits
from adjacent property owners or. other parties for the project.
The applicant acknowledges that, upon completion of construction, the Dis-
trict will own and maintain the water distribution system as constructed.
Construction
The applicant will pay all costs associated with the modifications of the
water distribution system as outlined under "Water" Sy stem Modifications,,"
to include the actual 'Costs, of materials,, -labor and overhead, and adminis-
trative and design costs.

Rates and charges
All water service made available by the District shall be at the established
rates and charges, including standby charges, connection and facilities fees,
as fixed by the Board of Directors from time to time.
Time limit
If, through no fault of the District, construction cannot be completed with-
in six months from the date of execution of this agreement by the District,
the District may elect to cancel this agreement and require the applicant to
enter into a new agreement.
Enforcement
In the event of any litigation to enforce the terms of this agreement, the
prevailing party shall recover its reasonable attorney's fees 'and costs.
The applicant certifies under penalty of perjury that he is the owner of the
property for which this water system modification is necessary, and grants
permission for the District to enter the property for construction and inspec-
tion of said modifications.

Project conditions
In order to provide water service as requested by the applicant, it is nec-
essary for the District's existing facilities to be modified.
The District will design or cause to be designed the modifications as out-
lined under "Water System Modifications," according to its Guidelines and
Standards for Water Systems. The District has full discretion to design,
plan or modify the water system as necessary.
The applicant will arrange for a contractor, licensed to construct water
systems within the State of California, to install the modifications, in
a workman-like manner, as outlined under "Water System Modifications," in
accordance with the Guidelines and Standards for Water Systems, and any
specifications imposed by the District. The contractor must provide the
District with a copy of an insurance policy listing the District as an ad-
ditional named insured, with combined property damage and personal injury
limits of $1,000,000. The contractor must also provide the District with
evidence of proper Workmans Compensation Insurance.
Prior to the commencement of construction, the applicant will provide to
the District appropriate easements and rights of way for access to the
water facilities, as designated by the District. The applicant acknow-
ledges that it may be necessary for him to obtain easements and/or permits
from adjacent property owners or other parties for the project.
The District will inspect the construction of the water system modifications.
All costs associated with the inspection will, be reimbursed by the applicant.
Upon approval of the modif icat ions, the applicant will dedicate the modif ica-
tions to the District, free and clear of all liens and encumbrances. Upon
acceptance, the District shall own, operate, maintain, repair and replace
such modif i cations in accordance with District Rules and Regulations.
The applicant agrees to indemnify and save harmless the District and its
employees from and against any and all injuries to and deaths of persons
and injuries to property, against any jaad all claims, duties, demands, costs,

losses, damage, liability and lawsuits, caused by the action or inaction of
the applicant or the applicant's contractors, agents or employees.
Nothing herein contained shall be deemed to limit, restrict or modify any
right, duty or obligation given, appointed or imposed upon the District by
the laws of the State of California now in effect or hereafter adopted.

Notif.cation prior to construction
Prior to the initiation of any construction, the applicant must notify the
District that construction is about to begin, must provide to the District
evidence of all insurance coverage required by this agreement, and shall

provide to the District the name, address, telephone number, and state license
number of the applicant's contractor.
