HomeMy WebLinkAboutRES 1984-28 - Board RESOLUTION NO 84 28 0 F THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT APPROVING SPECIFICATIONS AND CALLING FOR BIDS ON TWO ELECTRONIC RECLOSURES WHEREAS, the Board of Directors of the Truckee Donner Public Utility District has determined the need to purchase two electronic reclosures; and WHEREAS, specifications for said material is given in the schedule attached hereto; NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Truckee Donner Public Utility District does hereby approve the specifications describ- ed in the attached schedules, BE IT FURTHER RESOLVED that the President of the Board of Directors of the Truckee Donner Public Utility District is hereby directed to issue a call for bids based "on the specifications as described in the attached schedule, a and that the date and time established. for the bid opening is June 15, 1984 at 2:00 P.M. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a regular meeting thereof duly called and held in the Dis- trict on the 4th day of June 1-984, by the following roll call vote: AYES: Cooley, Corbett, Hamilton and Duffy. Time limit If, through no fault of the District, construction cannot be completed with-- in six months from the date of execution of this agreement by the District, the District may elect to cancel this agreement and require the applicant to enter into a new agreement. Payment, performance and maintenance bonds The District may, in the sole discretion of its General Manager, require that the applicant file with the District a performance bond in an amount satisfac- tory to the General Manager to guarantee faithful performance of all of appli- cant's obligations as set forth herein, and to payment guarantee a ment of all labor g and material costs incurred The District may, in the sole discretion of its General Manager, require that the applicant file with the District a maintenance bond in an amount satisfac- tory to the General Manager, to remain in effect for one year after completion of all work, to cover' any defects or failures in the modifications, Enforcement In the event of any litigation to enforce the terms of this agreement, the prevailing party shall recover its reasonable attorney's fees and costs, i The applicant certifies under penalty of perjury that he is the owner of the property for which this water system modification is necessary, and grants permission for the District to enter the property for construction and in- spection of said modifications.
