OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
AFFIRMING THE DISCHARGE OF MERRILYN MARSH
WHEREAS, MERRILYN MARSH was suspended from employment by the
District on April 12 , 1983; and
WHEREAS, on May 19 and 20 , 1982, a pre-disciplinary review
of the suspension and proposed discharge was held, and on May 21 ,
198/. , the review panel unanimously issued a document entitled
"FINDINGS AND DECISION OF PRE-DISCIPLINARY REVIEW PANEL"
affirming the proposed discharge of Merrilyn Marsh* and
WHEREAS, after an advisory arbitration proceeding an
arbitrator recommended that MERRILYN MARSH be rehired, but that
due to her past conduct she receive no compensation during the 19
months that she was terminated; and
WHEREAS, Section 14. 4 of the Memorandum of Understanding
between the District and IBEW Local 1245 provides that the
arbitrator' s recommendation is advisory only, and is not binding
up on the Board of Directors; and
WHEREAS, this Board has carefully reviewed the charges
against MERRILYN MARSHr the FINDINGS AND DECISIONS OF
PRE-DISCIPLINARY REVIEW PANEL the Employer' s Post-Hearing Brief,
the Union Brief, the District' s Response to the Union Brief , and
the Arbitrator' s Opinion and Recommendationo

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
the TRUCKEE DONNER PUBLIC UTILITY- DISTRICT as follows:
1'a The District declines to accept the recommendation of
the arbitrator;
2e The District adopts the FINDINGS AND DECISION OF
PRE-DISCIPLINARY REVIEW PANEL, dated May 21 , 1982;
3* The District' s discharge of MERRILYN MARSH is affirmed.
PASSED AND ADOPTED by the Board of Directors of the
Truckee Donner Public Utility district at a meeting held
within said District on the 16thday of January.._ 1984 ,
by the following roll call vote:
AYES: Cooley, Corbett, Duffy, Hamilton and Maass
NOES: None.
