Home My WebLink AboutRES 1982-54 - Board RES01JUTION NO. 2-) 54 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT ORDERING ANNEXATION OF LAND TO SAID DISTRICT REAL PROPERTY IN MARTIS VALLEY OWNED BY T-iATRELL AND MARTHA CROSBY WHEREAS, heretofore the owners of the land and property hereinafter described petitioned the Truckee Donner Publi,--1 Utility Di str ict and Placer County Local Agency Formation Commissi-on for the annexation of said land and property to the Truckee Donner Public Utility District, and said peti- tion was heretofore filed with the Executive Officer of the Placer County Local Agency Formation Commission; and WHEREAS, sald petition complied wJ_th the requireitients, of law,, and notice of the filing of said petition was duly, given in the manner required by law; and ' WHEREAS, the Executive Officer of said PL-icer C ounty Local Agency Formation Commission has reviewed said. 'Def.---ition and a hearing by said Com- mIssion was held in accordance with and as re q uired by law; and WHEREAS, said Local Agency Formation Commission, by Resolution No. 1-2-82 (copy of which is attached hereto as Exhibit "A", and made apart here- of) has approved and ordered said annexation of the prcperty hereinafter described; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utilit_-y District that there be and there is hereby ann ex e:�'d to the Truckee Donner Public Utility District a.1.1 that certain land and property situated in the County of Placer, State Of California, and more particularly bounded and described as follows, to Wit: See Exhibit "B" attached herel-to. BE IT FURTHER RESOLVED -that said annexation is subject to the following terms and conditions: Said land shall be subject to District rules and regulations, charges made, and assessments levied pursuant to the provi- si-ons of the Irrigation District law to pay for outstanding obligations of District, and also shall be subject to all assessments, tolls, charges I and standby charges hereinafter levied by District for any District purpose. 2. The land will be entitled to water from the District. Such service will be subject to the rules and regulations of the District regulating water service and payment of tolls and charges established by the District for such service. Developers of the subj ect prop erty shall accomplish the following or provide the equivalent: a) Transfer to the District, in exchange for the sum of $3 ,400, the easements described in Exhibit "CIO attached hereto and incorporated herein by refer- ence, in order to provide for the future installa- tion of a permanent looped water system within Dis- trict's service area b) Pay all necessary state and county annexation pro- cessing fees. c) Be solely responsible for the extension of all water lines existing upon the property Ln. the vicinity of Old MJ..11 Road and Frond Road to such water improve- ments as may be installed to service the parcels, upon application for water service. d) Enter into an agreement with the Distr i c t de ta i l ing the factual C-,Lnd legal. relationship between the partie s, and the terms as outlined in t-his, resolution. • e) Be responsible for payment- to the District of all necessary connection and faci-1it-J.-es fees in the approximate amount of $3 ,400, upon completion of the annexation process, recordatikon of easements, and application for water service. f) Provide adequate fire f]-Ow Protection in conformance with the- requirements established by the Truckee Fire Protection District. BE IT FURTHER RESOLVED by, the Board of Directors of the Truckee Donner Public Utility District that the Secretary of the Board cause copies of the order, certified by the Secretary of the Board of Directors, to be mailed to the Executive Officer of the Local Agency Formation Collmlission of the County of Placer for filing with the Offices of the Recorders of the Counties of Nevada and Placer, State of Californi_I.
