TRUCKEE DONNER PUBLIC UTII.JTY DISTRICT
ESTABLISHING POLICY FOR ACCEPTANCE OF' IMPROVEMENTS
WHEREAS, the California Public Utility District Act provides in Sec-
tion 16077 that all expenditures of money for the benefit of the Dik trict
and all contracts in -excess of $1.00,000 must be authorized by the Board of
Directors of the District by Ordinance; and
WHEREAS, the District enters into Development Agreements with pro-
ponents of various projects within the District, ranging from residential
subdivisions to recreational and commercial projests many of which involve
expenditures of money by Deveiopers. in excess of $100,Capp; and
WHEREAS, California Public Utility District Act Section 16072 provides
generally that the Board of Directors shall act by Ordinance , Resolution,
or motion; and
WHEREAS, the Board of Directors has routinely authorized the entering
into of Development Agreements by Ordinance in all cases, including those
cases in which the agreement called for an expenditure of money for the
benefit of the District in Lin amount less then $1-00,000; and
WHEREAS, the Board of Directors deslires to stre'Zimline the completion
and acceptance of projects Subject to its Devel.opment Agreements; so as
to facilitate integration of the completed projects into the District's sys-
tem; and
WHEREAS, in each case the District has and shall continue to authorize
the entering into of all Development Agreeril-ents calling for works of improve-
ment to be constructed in an amount of $100,000 or more by Ordinance).; and
WHEREAS,, the District desires to clarify its
policy with respect to
acceptance and dedication of a completed water and electrical improve me-,L,-I,t
project;
NOW, THEREFOREr BE IT RESOLVED by the Board of Directors of the Truc]tee
Donner Public Utility District that the policy of the District with respect
to the authorization and acceptance of projects subject to Development Agree-
ment shall be as follows:
1. All Development Agreements calling for works of improvement
in an amount of $100,000 or more to be constructed pursuant
to the District' s standards and gu-t0te-lines, shall be auth-
orized by Ordinance.
2. All Development Agreements calling t or works of improvement
in an amount less than $1.00,000 to be constructed pursuant
to the District' s stc-Indards, and guidelines, shall be auth-
orized by Resolution.
3. Acceptance of c-,ill works of ii-,ripr(.,)vem(3t-1t oubject t_o the, Di.(.-;-
trict' s standards and guidelires and constructed pursuant
to a Development Agreement, shall be accepted for transfer
and dedication to the District, by Resolution.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner
Public Utility Distr_ict at- a meeting held within said District on the 7-th
day of September, 1982, by the following roll call vote :
AYES: Corbett, Huber, Kuttel,, VanLandingham and Maass.
NOES: None.
ABSENT: None.
