HomeMy WebLinkAboutRES 1982-36 - Board r a-, ' 4 RESOLUTION NO. 8 236 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DECLARING DISTRICT INTENT TO ANNEX FOUR PARCELS OF REAL PROPERTY IN MART I S VALLEY (LATRELL CROSBY) the Owners of those certain four parcels of real property, WHEREAS, 111! U t- as described and set forth in Exhibit A , at hereto and incorpr'a. ed herein Y commonl known as Parcel A, Parcel B, Parcel C, and Parcel D, Latre ll and Mart C Martha ro sby husband and wife, have requested that such arc e l s be served b the Truckee Donner Public: Utility District; and P Y the Board of Directors has determined that it is in the WHEREAS, � ' best interests of the District to annex the property into the Distract s service area; and WHEREAS, the District intends to develop a permanent looped water system in the vicinity of Old Mill. Road and Frond Road which traverse such parcels; and WHEREAS t�1,� Distr_i..ct' OenerD-1 Manager hay, begun negotiations with the owners to determine a mutually acceptable method of serving the parcels mentioned above; and WHEREAS th.� Board of Directors has determined that in order to ul- r timat.el develop a �Dermanent looped water �y stem in the v.i.c in ity of the Y parcels described above, certain easements for the installation and main- tenance of wa.t!�r Lines will be necessary across and concerning those par- cels, and WH.'EREAS the owners have proposed that they transfer to the District the easements required by the District for the installation of its future '{ permanent looped water system, in exchange for lawful consideration; and WHEREAS, the District has determined that the fair market value of the easements as described in Exhibit "A", attached hereto and .incorporated here-- in by reference is equal to the value of connection and facilities fees for the four parcels; and W I EREAS, it has been determined that an Environmental Impact Report may be required to accomplish the annexation; and WHEREAS, the owners have agreed to pay for the necessary state and county processing fees to accomplish the annexation; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that annexation of Parcels A, B, C and D as described in Exhibit "A" proceed with the following conditions: 1. That the owners of Parcels A. B, C and D transfer to the District the easements described in Exhibit "A" attached hereto and incorporated herein by reference, in order to provide for the future installatioi of a permanent looped water system within the District's service area. 2.. The District shall purchase from the owners, those certain easements across and upon owners' Parcels A, B, C and D, as more particularly and accurately described in Exhibit "A" attached hereto and .incorporated herein, in exchange for the sum cif $3,400, which sum shall be paid to owners upon recording of the easements. 3. That the District shall process the necessary Environmental Impact Reports in connection with the annexation, process. 4. That the District's line extension re imbursentent policy, as in- corP orated in Rule 21 of the District's Ruler and Regulations, shall remain in full forge and effect. 9. That development of any improvements upon Parcels A, B, C and D will be subject to the availability of sewer hookups as pro- vide d within the policies and rules established by the Truckee Sanitary District. 10. That any developers of improvements upon Parcels A, B, C and D shall provide adequate fire flow protection in conformance with the requirements established by the Truckee Fire Protection Di - trice. 11. The owner shall file an appropriate application for annexation with the Local Agency Formation Commission of the County of Placer. PASSED AND ADOPTED by the Board. of Directors of the Truckee Donner Public z Utility District at a meeting held within said District on the 2nd day of August, 198 2, by the following roll call vote: AYES: Corbett, Ku t to l, vanLandingh.am and Maass.
