HomeMy WebLinkAboutRES 1983-21 - Board RESOLUTION NO. 8321 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT AUTHORIZING FILING OF THE TDPUD VILLAGE AT HIRSCHDALE ANNEXATION WITH THE NEVADA COUNTY LOCAL AGENCY FORMATION COMMISSION WHEREAS, the residents of the Village at Hirschdale, situate in the unincorporated territory of Nevada County, have requested annexation to the Truckee Donner Public Utility District by proper petition; and WHEREAS, the residents of the Village at Hirschdale have met with the District and have agreed to the terms and conditions for annexation estab- lished by the District such that they may assure themselves of an adequate and safe water supply, and adequate storage to meet residential and fire flow requirements; and WHEREAS,, the Village at Hirschdale lies within three miles of the easterly boundary of the TDPUD service area; and WHEREAS, the request for annexation was received from 37 of the Village of Hirschdale residents; and WHEREAS, the area to be annexed is shown on Exhibit "A" with descrip- tion attached thereto, and has been found feasible for annexation in ac- cordance with Chapter 17362 of the Public Utilities Code, such that the area to be annexed contains more than 20 acres and lies within three miles of the easterly boundary of the TDPUD; and WHEREAS, the Board of Directors has set forth the terms and conditions for said annexation, and has made the foregoing findings; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That the Village at Hirschdale annexation will facilitate the acquisition, repair, operation, maintenance and reconstruction of the domestic water system. 2. That, subject to the terms and conditions of annexation, the Truckee Donner Public Utility District will not operate at a dis- advantage. 3. That the annexation of the Village at Hirschdale will benefit from said annexation. BE IT FURTHER RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that the terms and conditions, in accordance with Sec- tion 17366 of the Public Utilities Code, shall be as follows: 1. That the Village at Hirschdale shall not become liable by as- sessment or otherwise for any outstanding obligations of the Truckee Donner Public Utility District, or any expense incurred in acquiring property for the servicing of any land within the Truckee Donner Pub- • lic Utility District, or any costs incurred in connection with the replacement or construction of any utility system within the Truckee Donner Public Utility District. 2. That the Village at Hirschdale shall be subject to such assess- ments as required to provide for any utility system improvements nec- essary to serve the territory and the costs of maintaining and op- erating such system. 3. That the annexation shall be contingent upon the Truckee Donner Public Utility District obtaining the necessary approvals from all relevant agencies and authorities. 4. That the Village at Hirschdale shall waive and will not be entitled to recieve, use or participate in any services, commod- ities, or property or some specific part thereof owned by the District or to which it may be entitled. 5. That the Truckee Donner Public Utility District may make appli- cation for grants or loans for the direct use in upgrading the Vil- Llge at Hirschdale's water system. 6. That the District attempt to negotiate an interim operating and maintenance agreement between the Truckee Donner Public Util- ity District and the present owner of the Village at Hirschdale Water System,, 7, That the Truckee Donner Public Utility District shall rece�ve all water service charges from the customers during this interim period; said funds received shall apply towards the maintenance, operation, administration, legal, engineering and annexation pro- ceeding costs. 8. That interim water service tariffs shall be set and amended from time to time based upon the revenue requirements necessary to provide administrative, maintenance, operation, and reconstruction of the Village at Hirschdale Water System. 9. That the Village at Hirschdale Water System be separate from the Truckee Donner Public Utility District except that the administra- tive cost shall be in proportion to the total number of the Village at Hirschdale service connections, as to the sum total of the water connections in both systems. 10. That the total area comprising the Village at Hirschdale, as shown on the attached map marked Exhibit "A" be annexed to the Truckee Donner Public Utility District. BE IT FURTHER RESOLVED, that the Staff of the Truckee Donner Public Utility District is hereby directed to file said app lication of annexation with the Nevada County Local Agency Formation Commission. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Pub- lic Utility District at a regular meeting duly called and held within said District on the 18th day of April, 1983, by the following roll call vote: AYES: Maass, VanLandingham and Corbett.
