RESOLUTION NO. 83 69
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
APPROVING DEVELOPMENT AGREEMENT, PLANS
AND SPECIFICATIONS FOR THE
SUPER 8 MTEL _
WHEREAS, a development agreement permit between the Truckee Donner Public
Utility District and developers of the —Super 8-.-M_otel
has been drawn up and executed by staff; and
WHEREAS, plans and specifications for the project have been submitted and
the District's Water and Electrical Engineers have recommended their approval;
and
WHEREAS, appropriate fees have been determined and set forth in the agree-
ment by the District, and paid by the developer;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee
Donner Public Utility District as follows:
1. The Board of Directors does hereby approve the develop-
ment agreement between the Truckee Donner Public Utility
District and Brown, Bro sche F inanc is 1 t Incorporated •
developers of the Super 8 Motel -
2. The Board of Directors does hereby approve the plans and
specifications for the Super 8 Motel
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public
Utility District at a meeting held within said District on the 7th day of
November , 1983, by the following roll call vote:
AYES: Maass, VanLandingham and Corbett.

PROJECT DESCRIPTION
A. Relocation of Feeder Pole "Q" and Feeder Pole "C," to include the
removal of two (2) existing 45' poles and guys at the southwest corner of the
development, and the installation of one (1 ) 50' pole with the placement of
Feeders B and C on same.
B. Extension of the underground electrical system, approximately 800
feet of 350 MCM Al 600V cable.

C. Installation of one (1) underground service connection.

installation of one (1 ) 2" domestic water service, with One (1 )
{" irrigation line connected by developer after metered point. The 2" service
is to be tapped off of existing 8" AC water main at. Deerfield Drive by Develo-
per, to be inspected by District.
E. Installation of one (1 ) 411 fire service connection, to be installed
and tapped off of existing 8" AC water main at Deerfield Drive by Developer,
to be inspected by District.
F. Installation of one (1 ) fire hydrant at the southwest property corner,
further identified in Exhibit 1 , to be installed and tapped off of the existing
8'' AC water main at Deerfield Drive by Developer, to be inspected by District.

A reemen t/Permit executed b BROWN, BROSCHE FINANCIAL, INCORPORATED,
(herein referred to as "Developer") and the TRUCKEE-DONNER PUBLIC UTILITY DIS-
TRICT herein referred to as "District,") will serve as the instrument of mutual
agreement between the Developer and the District.
Upon execution of this instrument, the Developer agrees to perform certain
construction and payment obligations required by the District to insure proper
installation of the domestic water and electrical systems as set forth herein:
A. The District acknowledges receipt of the Developer's improvement plans;
properly prepared by a licensed Civil Engineer;
B. The Developer will hire a licensed General Engineering Contractor,
authorized to construct civil works within the State of California;
C. The District acknowledges receipt of the $750.00 preliminary Agreement/
Permit processing fee;

D. The Developer agrees to deposit with the District the following sums
(as minimums) in order to cover the District' s costs incurred for plan checking
and construction inspection :
a) Plan Checking $300,00
b) Field Inspection $300,00
E. The Developer agrees to reimburse the District for any additional
costs it may incur in the performance of the plan check review and field inspec-
tion for, this project;

F. The Developer agrees to pay the District electrical connection and
facilities as follows for an underground, three-phase service:
a) 30 Underground Connection Fee $ 650-00
b) 30 Facilities Fee, (220KW) 17600.00
Sub-Total $18250-00
G. The Developer agrees to pay the District the estimated costs for the
relocation of 6 and C Feeder Poles, in addition to the estimated costs of the
primary underground extension, as follows:
a) B & C Feeder Relocation $ 4931 .00
b) Underground Primary Extension 6435.40
Sub-Total $11366,00
The Developer agrees to pay the actual costs to the District, which will be
determined upon completion of the job. The Developer will be refunded if the
estimate exceeds the actual costs, or billed if the project costs exceed this
estimate.
TOTAL ESTIMATE $29616.00
H. The Developer agrees to pay to the District water connection and
facilities fees as follows fora 2" water service and a 4" fire service line:
a) 2" Connection Fee $ 600,00
b) 2" Facilities Fee 1200.00
c) 4" Fire Service Connection Fee 6000-00
TOTAL WATER FEES $ 7800-00

Developer herebyreleases and agrees to indemnify and save the District
harmless from and against any and all injuries to and death of persons, and
injuries to property, or other interests, and any and all claims, duties,

demands costs, losses, damage, liability, and lawsuits, howsoever the same
may be caused asserted at an time, by any and all persons, firms, corporations

and other entities which directly or indirectly result from the performance
or non p an performance of and all construction, which may directly or indirectly

and/or water distribution systems herein described* Such indemnification shall
include reimbursement of attorney' s fees.
EVIDENCE OF INSURANCE
Prior to the commencement of any construction pursuant to this agreement,
Developer shall furnish to the District satisfactory evidence of an insurance

District insuring the District, its officers, agents and employees against loss
or l iabi 1 i tY w may arise during the construction, or which may result from

any of the work or construction herein required bo be done, including all costs
defending an claim arising as a result thereof. The minimum limits of such

policy shall be in the amount of $500,000-00 for the death of or injury to any
person rson in one accident, and $5,000,000-00 for the death of or injury to more than
one Person in any one accident, and $100,000.00 for property damage i n any one

permit . Said insurance policy shall state by its terms and by an endorsement
that it shall not be cancelled without 30 days written notice prior thereto
given to the District.
EFFECTIVE DATE OF AGREEMENT/PERMIT

e effective date of this agreement/permit shall be eighteen (18) months
from the date of execution hereon*

GOVERNING LAW
This agreement and each of its severable provisions shall be governed by
and construed in accordance with, the laws of the State of California.
