AUTHORIZING THE EXECUTION OF A ..QUITCLAIM DEED TO TRUCKEE INVESTORS, A PARTNERSHIP WHEREAS , Don Casler, real estate agent for Truckee Investors, a partnership, approached the Board of Directors of the Truckee-Donner Public Utility" District seeking to remove that portion of a blanket. easement which was a cloud on the title of a 4.0 acre parcel •located on Old Highway 40 (herein "subject property") between the elementary school and as sta- tion; and WHEREAS , said easement related to wells, water pipes, and related pump facilities as they existed in an original 327.73 acre parcel; and WHEREAS,, the District Engineer has reported a lack of water facili- ties on or across subject property. In the event that any wells exist, they are not under the ownership of the Truckee-Donner Public Utility District and are not constructed to State Well Standards; and WHEEAS , the 0 District Engineer, District Counsel, and Manager have made recommendations to the Board in favor of the-adoption of this Resolution; and WHEREAS, the Well Abandonment Agreement prepared by the District Engineer has been approved as Resolution No,, 7917 . Said agreement pro- vides, among other things, the method of abandoning any wells found on the property during the course of grading and excavation; and WHEREAS , Truckee Investors has entered into an agreement with the Truckee-Donner Historical Society regarding the relocation of the historical White Cross, commonly known as the Donner Cross , ma'rking the Donner Trail, and the bronze plaque identifying the location of the Graves' Cabin of the 1846-1847 Donner Party tragedy, along with providing public access to the site. NOW THEREFORE, BE IT RESOLVED by the Board 'of Directors of the Truckee-Donner Public Utility District, as follows: That the President and Clerk of the Board of Directors cause to be executed the Q uitclaim Deed, a copy of which is attached hereto and, by this -reference, made a part hereof.
