Board of: SupervI sors for approval; and WHEREASf the Board of Sup ervi sors of the County of Nevada, at their I lrie.r Public Utility meeting of November to, -980, approved the Truckee Don, District' s Confli_c.t of Interest Code; BE IT ENACTED by the Board of Directors of -the Truckee Donner Public Utility District as follows: 1. The District hereby adopts the Conflict Of Interest Code attached hereto and incorporated herein by -this ref-e-rence. ide reasonable assurance that 2. Any business entily in which the official has a direct or indirect investment worth more than $1,000*00; b, Any real property in which the official has a direct or indirect interest worth more than $1,000.00; C. Any source of incom e, other than loans by a commercial lending irtstitution in the regular course of business, aggregating $250.00 or more in value received by or promised to the official within twelve months prior to the tifne when the decision is made; or d Any business entity in which the official is a director, officer, artner, trustee, employee, or holds any positi-on of management. No asset shall be deemed an investment unless its fair market value exceeds $1,000-00. "Material Financial Effect": a. The financial effect of a governmental decision on a financial interest of an official is material. if, at the time the official makes, or partici ates "in maki!j& the decision, in light of all the circumstances and facts known at the time of the decision, the official knows or has reason to know that the existen ce of the financial interest might interfere with his performance of his duties in aii impartial manner free from bias. SECTION E MANNER OF REPORTING 1. The nam e of the business entity in which each investment is held, and a general description of the business activity in which the business entity is engaged* I C. This information need not be provided with respect to an interest in real j2ropert which is used principally as the residence of the filer; .e. St.ECTION G OPINIONS OF THE ComMISSION AND COUNSEL Any .official. who is unsure of w-iy duty, right, or privilege of participation in any matter under this Code or under the provi•sions of the Political Reform Act of 1974 niay request the Fair Pol.itical Practices Commission to issue an Opillion with r •espect to his duties under 9 1 le 9 of the Government Code. At the time such request is fnade, or thereat ter, the attorney for the District may file with such request a proposed opinion with respect to the official's dunes. The attorney shall state the fact.(_; upon which his opinion is based, and all such opinions sha1l con t a in ci tations of the law or Other authorities and be public records, of the District.
