DRECTNG THAT COMPETITIVE BIDDING BE DISPENSEQ W1T IN . ONNEGTION WITH-t THE DISTRICT'S PURCHASE OF RECLOSERS AND . .......... ........ .. ......REC .OSER CONTRtS .... ..... WHEREAS, the Truckee Donner Public Utility District has determined the need to acquire Cooper Power System reclosers and microprocessor-based recloser controls; and WHEREAS, the reclosers and microprocessor-based controls were included in the 1993 budget; and WHEREAS, Public Contract Code Section 20206.4 generally requires that the District seek competitive bids in connection with the purchase of goods; and WHEREAS, various California court decisions, including Graydon v. Pasadena ~~ Development Agenc 104 C.A. 3d 631 (1980), hold that if the subject of a contract is such that competitive proposals would be unavailing or would not produce an advantage, and the advertisement for competitive bid would thus be undesirable or impractical, a public agency may dispense with competitive bidding; and WHEREAS, the District has a large investment in the Cooper Power Systems reclosers and controls, using them exclusively; and WHEREAS, the District has a large investment in the Cooper Power System reclosers and controls, using them exclusively; and WHEREAS, the exclusive use of Cooper Power System reclosers and controls reduces costs in inventory of parts; and WHEREAS, the exclusive use of Cooper Power System reclosers and controls allows for interchangeability within the system; and WHEREAS, the exclusive use of Cooper Power System reclosers and controls does not require additional training of District personnel, and WHEREAS, the exclusive use of Cooper Power System reclosers and controls will be more compatible with future SCADA plans; and r�— WHEREAS, the exclusive use of Cooper-Power.System reclosers and controls has the potential of shortening outages by staff being familiar with the same equipment from m station to station; and WHEREAS, due to the facts set forth above, competitive bidding would be unavailing_ and would not produce an advantage to the District, and the advertisement for competitive bids and the delay that would therefore result, would be undesirable; NOW, THEREFORE, BE IT RESOL VED by the Board of Directors that the recitals set forth above are adopted as findings and for the reasons set forth herein finds that competitive proposals for the above described electrical apparatus would be unavailing, would not produce an advantage to the District;further, the advertisement for competitive bids and the resulting delay would be undesirable. BE IT RESOL VED FURTHER that District staff is hereby authorized to dispense with competitive bidding and purchase Cooper Power System reclosers and microprocessor based recloser controls. PASSED AND ADOPTED at a regular meeting of the Board of Directors of the Truckee Donner Public Utility District duly called and held in said District on the 1st day of March 1993 by the following roll call vote: A YES: Corbett, Jones, Maass and Aguera.
