OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
DIRECTING THAT COMPETITIVE BIDDING BE DISPENSED WITH IN
CONNECTION WITH THE PLACEMENT OF UTILITY BLOCKOUTS AND
ACCESS OPENINGS ON THE CALTRANS BRIDGE OVER INTERSTATE 80
AT HIGHWAY 89
WHEREAS, Cal Trans is constructing a new bridge across 1-80 at Highway 89; and
WHEREAS, the District can save substantial amounts of public funds by arranging for the
future placement of water and electrical utility facilities in the bridge during its initial
construction; and
WHEREAS, BENCO Construction and Engineering, Inc. was selected by Cal Trans to
construct the new bridge after engaging in a competitive bid process; and
WHEREAS, it is not practical for any other contractor to install facilities in a bridge that
is being construction by BENCO; and
WHEREAS, BENCO has agreed to perform the necessary work for the amount of
$39,390, which amount is reasonable in the professional judgment of the District's
consulting engineer; and
WHEREAS, there is a short construction season in Truckee and it is at this time already
late in the season necessitating that a decision be made in a timely manner, and
WHEREAS, various California court decisions, including Graydon v. Pasadena
Development Agency, 104 C.A. 3d 631 (1980), hold that if the subject of a contract is
such that competitive proposals would be unavailing or would not produce an advantage
and the advertisement for competitive bids would thus be undesirable or impractical, a
public agency may dispense with competitive bidding, and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors that for the reasons
set forth above, the District finds that competitive bidding for the placement of utility
blockouts and access openings on the Cal Trans bridge over 1-80 at Highway 89 would
not produce an advantage to the District and the advertisement for competitive bids would
not produce an advantage to the District and would be undesirable and costly.
BE IT FURTHER RESOLVED that the District shall therefore dispense with competitive
, .., bidding for the placement of utility blockouts and access openings on the Cal Trans bridge
over 1-80 at Highway 89 and District is authorized to enter into a contract directly with
BENCO Construction and Engineering, Inc. in the amount of$39,390 for said work.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held
within the District on the 19th day of September 1994 by the following roll call vote:
AYES: Aguera, Sutton and Maass,
NOES: None.
ABSENT: Corbett and Jones.
