WHEREAS, the voltage regulator located in the Martis Valley Substation has failed; and
WHEREAS, the voltage regulator enables the District to maintain a steady voltage throughout its
distribution lines originating out of the Martis Valley Substation; and
WHEREAS, without a voltage regulator, the distribution lines originating from the Martis Valley
Substation may experience a decrease in voltage as the demands for electricity increase during
a particular day, and
WHEREAS, for the typical customer a decrease of a few volts will not be detected, and
WHEREAS, for certain customers with voltage sensitive equipment, a decrease in voltage may
damage equipment, and
WHEREAS, the Martis Valley Substation is a major substation within the District's electric
distribution system and services certain large commercial customers such as Teichert and the
Truckee Sanitary District as well as light commercial and residential customers; and
WHEREAS, the certain large commercial customers served by the Martis Valley Substation have
voltage sensitive equipment which detects a voltage decrease as small as a half of a volt, and
WHEREAS, the District has temporarily transferred the critical electric load of the Martis Valley
Substation to the Truckee Substation to minimize the risk of damage to customers' voltage
sensitive equipment, and
WHEREAS, the District's temporary solution for the failed voltage regulator is not a long term
solution because the load transferred to the Truckee Substation is causing the Truckee Substation
to perform at near capacity and the customers continuing to be served by the Martis Valley
Substation may experience decreases in voltage during peak demand periods which may damage
voltage sensitive equipment; and
WHEREAS, it is possible to temporarily shut down the Martis Valley Substation and distribute the
load between the remaining substations, but it is not feasible to handle peak electric demand period
without Martis Valley Substation in operation; and
WHEREAS, it has been determined that it is necessary to obtain a replacement voltage regulator
for the Martis Valley Substation as soon as possible to minimize the risk of damage to customers'
voltage sensitive equipment and to ensure that the District is able to provide electricity to meet its
peak demand periods; and
WHEREAS, the total cost of replacing the voltage regulator is approximately$17,000; and
WHEREAS, the Public Contract Code Section 20201 generally requires that the District engage
in competitive bidding on any expenditure in excess of$10,000; and
WHEREAS, it has been determined by District staff that it is not possible to engage in competitive
bidding for the purchase of a voltage regulator without serious delays which would place the
District's customers at considerable risk; and
WHEREAS, Public Contract Code Section 22050 provides that in the case of an emergency, a
public agency, pursuant to a four-fifths vote of the governing body, may repair or replace a public
facility, take any directly related and immediate action required by that emergency and procure the
necessary equipment services and supplies for those purposes without giving notice for bids to let
contracts; and
WHEREAS, the District's need to purchase a voltage regulator immediately has created a great
emergency which, pursuant to Public Contract Code 22050, is justification for the District to
dispense with the competitive bidding procedures for the purchase of a voltage regulator,
NOW THEREFORE BE IT RESOLVED that the Board of Directors of the District adopts the above
recitals as its findings, and
BE IT FURTHER RESOLVED by the Board of Directors that for the reasons set forth above, the
District finds that the failure of the voltage regulator in the Martis Valley Substation has created an
emergency and that the emergency will not permit a delay resulting from a competitive solicitation
for bids and that the purchase of a voltage regulator is necessary to respond to the emergency.
BE IT FURTHER RESOLVED that the District shall therefore dispense with competitive bidding for
the purchase of a voltage regulator for the Martis Valley Substation.
BE IT FURTHER RESOLVED that the Board of Directors shall review the emergency action at its
next regularly scheduled meeting and at every regularly scheduled meeting thereafter until the
action is terminated to determine whether there is a need to continue the action.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the
District on the 19th day of February 1997 by the following roll call vote:
AYES: Aguera, Jones, Maass, Sutton and Hemig.
