BE PERFORMED BY THE DISTRICT AS A CURRENT AND ORDINARY LINE EXTENSION WHEREAS, six properties on Foxmead Lane had their individual drinking water wells contaminated by the January 1997 floods and residents of Foxmead Lane have expressed a desire to receive water from the Truckee Donner Public Utility District; and WHEREAS, the estimated construction cost of the project to provide water service to the properties located on Foxmead Lane is $21,000.00; and WHEREAS, District staff recommends that the District extend its water main line, which is currently serving the Truckee Business Park, 470 feet to serve the six properties on Foxmead Lane using its own work force under Truckee Donner Public Utility District Code Section 6.60.010 ("TDPUD Code") and Public Contract Code Section 20205.2; and WHEREAS, District staff recommends that at the time the individual property owners connect to water service on Foxmead Lane, they reimburse the District for their proportional cost associated with providing water to their property using the Foxmead Lane water line and pay the appropriate fee to the West River Street Assessment District; and WHEREAS, Public Contract Code Section 20205.2 permits the board to do or cause "to be done directly by the district, and without any contract, any or all work necessary or proper in or about the making of all current and ordinary repairs or in or about current and ordinary upkeep or maintenance;" and WHEREAS, according to TDPUD Code Section 6.60.010, the District construes the terms `all current and ordinary repairs' and `current and ordinary upkeep or maintenance', as contained in Public Code Section 20205.2, to include the"repair, upkeep and maintenance of the entire District water and electrical distribution systems, to allow for routine extension and expansion of District electrical and water facilities to meet the increased demand placed on such systems by the growing needs of District customers, and to include minor and routine work which District staff is capable of performing;" and WHEREAS, according to TDPUD Code Section 6.60.010.4, an example of work that falls within the terms `current and ordinary repairs' and `current and ordinary upkeep or maintenance', is "minor water line extensions, such as that needed to complete a water loop system, having a length of 500 feet or less;" and WHEREAS, according to TDPUD Code Section 6.60.010, the list of work falling within the terms `current and ordinary repairs' and `current and ordinary upkeep or maintenance' is not exhaustive, and"the District may determine that other similar types of work are included within the terms `current and ordinary repairs' and `current and ordinary upkeep or maintenance' as contained in Public Contract Code Section 20205.2;" and WHEREAS, the proposed Foxmead Lane water line extension appears to be a routine extension and expansion of District water facilities to meet the growing needs of the District, in that it is under 500 feet and it is minor and routine work which District staff is capable of performing; and WHEREAS, the Board has the authority, pursuant to TDPUD Code Section 6.60.010, to determine the types of work that fall within the terms `current and ordinary repairs' and `current and ordinary upkeep or maintenance' as contained in Public Contract Code Section 20205.2. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. The recitals set forth above are hereby adopted as findings of the Board of Directors of the Truckee Donner Public Utility District. 2. The Board of Directors hereby approves that the minor water line extension may be constructed by the District's work force to provide water service to Foxmead Lane pursuant to Public Contract Code Section 20205.2 and TDPUD Code Section 6.60.010. 3. The Board of Directors hereby approves that the project be financed by the District with repayment of the proportional project costs by the Foxmead property owners as they connect to water service, as well as payment of the appropriate West River Street Assessment District fee at that time. 4. If any property owner on Fixmead Lane chooses not to participate, the District will pursue avenues to require hook-up in accordance with law or will record an appropriate document with the County of Nevada putting future buyers of the property on notice of the payment required to hook-up to the water system.
