TR/CT STATtNG.,CONGSRNS REGARDING NEGOTIATION OF THE TRUCKEE RIVER OPERATING AGREEIVIENT AND REQUESTING'THAT THE STATE MC.ALIFORNIA'REFUSE TO FINALISE THE ENVIRONMENTAL C�OGUMENTS AND.REFUSE TO'SIGNM E AGREEMENT UNTIL THE REGION INTERESTS ARE PRQPERLY ADC3RESSED WHEREAS Public Law 101-618, enacted by the United States Congress in 1990, establishes an interstate allocation of the water resources of the Truckee River Basin, and requires the negotiation of a Truckee River Operating Agreement (TROA) to manage the limited resources and provide mitigation for any significant environmental impacts resulting from the operation of the River; and WHEREAS the California Department of Water Resources is the lead agency in negotiating California's interest in the TROA and is the co-lead with the U.S. Department of Interior in preparing the environmental impact report for the Agreement; and WHEREAS the Truckee River Basin Water Group (TRBWG) was formed in 1994 as an organization of county, city, resource management agencies and public water and sewer districts within the California portion of the Truckee River Basin to provide a vehicle to represent local interests in the TROA negotiations; and WHEREAS Truckee Donner Public Utility District (District) is a member of the Truckee River Basin Water Group, and the District is a purveyor of water in the greater Truckee Community and as such has a keen interest in management of the limited water resources in the Truckee River Basin; and WHEREAS the operation of the Truckee River system and the area reservoirs has and will continue to have significant implications on the economy and environment of the Truckee River Basin within California; and WHEREAS before the TROA can be approved and executed, it must undergo environmental review pursuant to the California Environmental Quality Act which must disclose all potentially significant environmental impacts and identify mitigation measures to reduce said impacts; and WHEREAS the draft environmental impact report on the TROA was released on March 10, 1998 and the District and the Truckee River Basin Water Group responded that the document does not comply with CEQA and fails to provide meaningful information regarding the long term impacts of the TROA; and WHEREAS TROA proposes to establish permanent standards for the operation of the River system and its impacts are of paramount importance to our region; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT that the Governor of the State of California not authorize the signing of the TROA until: .�--, (1) The EIR/EIS is significantly modified to provide complete and legally adequate documentation of the long-term impacts of the implementation of TROA, (2) The TROA contains adequate language defining mid-course correction and depletion of the California water allocation. BE IT FURTHER RESOLVED that the District requests that the Governor of California instruct all State agencies with responsibility to oversee resources potentially impacted by the operation of the Truckee River to coordinate their actions so that the interests of our region are clearly and comprehensively understood and protected. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a meeting held within said District on the 20th day of January 1999 by the following roll call vote.
