HomeMy WebLinkAboutRES 1999-10 - Board RESOLUTION NO. 9910 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DISPENSING WITH BIDDING IN CONNECTION WITH THE PURCHASE OF VAULTS FOR THE HIGHWAY 267 BYPASS PROJECT WHEREAS, the Truckee Donner Public Utility District has determined the need to acquire Jensen Pre-cast Concrete Products, specifically vaults and enclosures, for the Highway 267 Bypass project; and WHEREAS, the concrete products were included within the project approved in the 1999 budget; and WHEREAS, Public Contract Code Section 20206.4 generally requires that the District seek competitive bids in connection with the purchase of goods; and WHEREAS, various California court decisions, including Graydon v. Pasadena Development Agency, 104 C.A. 3d 631 (1980), hold that if the subject of a contract is such that competitive proposals would be unavailing or would not produce an advantage, and the advertisement for competitive bid would thus be undesirable or impractical, a public agency may dispense with competitive bidding; and WHEREAS, the District has a large investment in the use of Jensen Pre-cast Concrete Products, having used them exclusively in the past; and WHEREAS, the use of Jensen Pre-cast Concrete Products reduces costs in inventory of parts: and WHEREAS, the use of Jensen Pre-cast Concrete Products allows for interchangeability within the system; and WHEREAS, time is of the essence in the procurement of the required equipment and delay would result in a stoppage or slow down of the mandated Cal Trans project thus preventing the District from meeting the deadline for installation of electrical components within the project boundaries; and WHEREAS, due to the facts set forth above, competitive bidding would be unavailing and would not produce an advantage to the District, and the advertisement for competitive bids and the delay that would therefore result, would be undesirable; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors that the recitals set forth above are adopted as findings and for the reasons set forth herein finds that competitive proposals for the above described concrete products for the electrical system would be unavailing, would not produce an advantage to the District; further, the advertisement for competitive bids and the resulting delay would be undesirable. BE IT RESOLVED FURTHER that District staff is hereby authorized to dispense with competitive bidding for this project and purchase Jensen Pre-cast Concrete Products. PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the District on the seventh day of July 1999 by the following roll call vote: AYES: Aguera, Hemig, Sutton and Jones.
