Ordinance No. 2001 =04
Amending the water facilities fee policy found in Ordinance 2001-01
WHEREAS the District adopted Ordinance No. 2001-01 establishing the water facilities fee; and
WHEREAS said Ordinance defined "New Development"to mean construction of residential
improvements, construction of commercial or other non-residential improvements, or the addition of floor
space to existing improvements which involve the issuance of a permit for construction or reconstruction;
and
WHEREAS the Board held a public hearing on November 28, 2001 to receive testimony regarding the
application of the water facilities fees to the addition of floor space to existing improvements which involve
the issuance of a permit for construction or reconstruction; and
WHEREAS the Board wishes to repeal that section of Ordinance No 2001-01 that applies the water
facilities fee to the addition of floor space to existing improvements which involve the issuance of a permit
for construction or reconstruction;
NOW, THEREFORE, BE IT ORDAINED that the Board of Directors of the Truckee Donner Public Utility
District does hereby enact the following:
A. Section 1 of Ordinance 2001-01 is amended to read as follows:
1. "New Development" shall mean construction of residential improvements, construction of
commercial or other non-residential improvements.
B. This Ordinance shall be effective retroactively to May 7, 2001
C. All other ordinances of the District shall remain in full force and effect except to the extent that they
may conflict with the provisions of this ordinance.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the district
on the 19th day of December, 2001 by the following roll call vote:
AYES: Aguera, Maass, Hemig, Sutton and Van Gundy
NOES: None
ABSENT: None
