Public Resolution No. 2001=01 Authorizing the transfer of funds from water facilities fees to the water general fund WHEREAS, the State of California adopted, in 1988, AB 1600 which regulates the manner in which the District shall administer the collection and use of facilities fees; and WHEREAS, the District adopted Ordinance No. 8903 entitled Water and Electric Facilities Fee Ordinance and also adopted an administrative code for implementation and collection of facilities fees; and WHEREAS, the District, in 1991, adopted a water system master plan to guide its water system expansion as development occurred; and WHEREAS, the District has collected facilities fees prior to and subsequent to the effective date of AB 1600; and WHEREAS, on March 5, 1997 the District adopted an updated water system master plan and revised the facilities fees effective May 7, 1997; and WHEREAS, the District determined that because the water system is an integrated water system, upgrades and improvements to any part of the system would result in an improvement to the whole water system; and WHEREAS, effective May 7, 1997 the District determined that the water facilities fees collected should be categorized as"Global"and could be used for system-wide improvements as identified in the updated water system master plan (Water System Master Plan 1995 - 2015); and WHEREAS, all of the funds collected and categorized as Post AB 1600 have been spent on previous water projects that qualified for facilities fees reimbursement; and WHEREAS, the District's records show that there is a balance of accumulated interest in the Post AB 1600 account of$158,099 which is not allocated to any zone of benefit; and WHEREAS, projects have been undertaken by this District that qualify for facilities fee expenditure; and WHEREAS, District staff has prepared a report entitled Report on Facilities Fees Reimbursement for Water Projects; NOW THEREFORE BE IT RESOLVED by the Board of Directors of the District as follows: .. • That it adopts the Report on Facilities Fees Reimbursement for Water Projects as its finding. • That it approves the transfer of the following water facilities fees to the water general fund: Post AB 1600, $158,099 and Global $309,102 REPORT ON FACILITIES FEES REIMBURSEMENT FOR WATER PROJECTS: 1/17/01 The following projects qualify for funding from facilities fees: WO# 99-74501 & 00-74503 Martis Valley Well (Brockway Well) ($404,729) This project was for the exploration and drilling of a water production well. This project is complete. This project should be considered global in nature and not zone specific. WO# 00-74512 Hydrologic Study for new Water Well Sites. ($47,508) This project was for a study to determine locations to drill exploration wells and a water production well for a new water source. This project should be considered global in nature and not zone specific. WO# 00-74513 Drilling of Test holes for Water Source ($14,964) This project was for the drilling of test holes for a future water production well. This project is not complete. This project should be considered global in nature and not zone specific. TOTAL FACILITY FEE TRANSFER: $467,201 - That the projects that have been identified for facilities fees reimbursement are as follows: WO# Description Amount Zones 99-74501 & 00-74503 Martis Valley Well $404,729 All zones 00-74512 Hydrologic study for wells 47,508 All zones 00-74513 Drill test holes for wells 14,964 All zones Total water facilities fees projects 4 7 1 PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the District on the 17t' day of January, 2001 by the following roll call vote: AYES: Aguera, Hemig, Sutton and Maass.
