Resolution No. 2006 - 04
AUTHORIZING AN ABANDONMENT, AS TO ITS INTEREST,
OF THE PUBLIC UTILITY EASEMENT
ON APN's 46-310-20 and 46-310-21
WHEREAS, Robert and Shoshana Lamberg and James and Kathleen McCann through the
Town of Truckee have requested abandonment of a 16-foot wide public utility easement
along the side property line between 14792 Alder Creek Road (APN 46-310-20)and 14808
Alder Creek Road (APN 46-310-21);
WHEREAS, District staff has investigated the matter and determined that such
abandonment would not cause the District problems in providing electrical or water service;
WHEREAS, the Town of Truckee has indicated that a new 16-foot wide easement will be
dedicated on the new property line;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner
,�- Public Utility District as follows:
That the President of the board be authorized to execute a statement
indicating that the Truckee Donner Public Utility District has no objection to
the abandonment of the above-described public utility easement as shown
on the attached map, which has been entitled Exhibit "A".
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held
within the District on the fifteenth day of February, 2006 by the following roll call vote:
AYES: Directors Hemig, Sutton, Taylor and Thomason
NOES: None
ABSENT: None

PROJECT DESCRIPTION:
The applicant, K. B. Foster Civil Engineering, Inc. are requesting the abandonment of a 16-foot
public utility easement located at 14808 Alder Creek Road. This easement runs along the
property's northern side property line. The applicant is requesting the easement abandonment so
that it may correspond with the proposed Lot Line Adjustment (Town Application No. 05-
055/LLA). Currently the residence on lot 46-310-21 is constructed over the property line of
APN 46-310-20. The proposed lot line will be relocated to allow the residence to be located
entirely on APN 46-310-21, and within the required setbacks of the parcel.
The above-referenced request for an abandonment of a public easement has been submitted for
review to the Community Development Department, Planning Division. Please review the
requested abandonment, complete the comment sheet on the back, and return your comments to
this office by r 13 '1,666 . Also please feel free to provide any additional comments or
information you may have on the requested abandonment.

Letter of Justification:
The applicants are requesting an abandonment of a 16 foot public utility easement
located along the northern property line of APN 46-310-21 of the Tahoe
Subdivision. The easement is proposed to be abandoned and relocated due to a
proposed Lot Line Adjustment (Town of Truckee file#05-055).
In the current condition a residence is constructed on APN 46-310-21 over the

line of APN 46-310-20. In the proposed condition, the lot line will be relocated o a al ow

of that parcel. The 16 foot public utility easement will be abandoned and relocated ted to setbacks
