TRUCKEE D O i Public Utility District Resolution No. 2006 - 26 AUTHORIZING AN ABANDONMENT, AS TO ITS INTEREST, OF THE PUBLIC UTILITY EASEMENT DESCRIBED IN ORNC 2002-040397 WHEREAS, the developer of Pioneer Commerce Center Phase 3 has requested abandonment of the public utility easement described in ORNC 2002-040397; WHEREAS, the developer of Pioneer Commerce Center Phase 3 has granted a new public utility easement and access easement that is functionally equivalent to the easement described in ORNC 2002-040397; WHEREAS, District staff has investigated the matter and determined that such abandonment would not cause the District problems in providing electrical or water service; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: That the President of the board be authorized to execute a statement indicating that the Truckee Donner Public Utility District has no objection to the abandonment of the public utility easement described in Exhibit"A" and as shown on the attached map, which has been entitled Exhibit "B". At present there are various easements recorded over Trails End Road (also designated as area `J)on this Parcel Map, recorded in Book 19 of Parcel Maps at page 175. These are for the installation and maintenance of sewer, gas,water, etc., as well as public ingress and egress and emergency access for public, County or State agencies. The wording on the Parcel Map does not, however, grant the Truckee Donner Public Utility District access to their property located at the southwesterly end of Trails End Road for purposes of daily routine travel. It is their wish to have such an easement recorded to correct this oversight. In order to accomplish this, it is necessary that all owners of property designated on the Parcel Map,sign the attached form agreeing to such an easement being recorded. The proposed easement will follow the existing limits of Trails End Road including the cul-de-sac at the southwesterly end, but will exclude the short stretch of roadway known as Trails End Court. The limits of Trails End Road to be encumbered by the easement have been demarcated as the hatched area on the attached Exhibit"C"map. In what can be considered as a simultaneous transaction, Truckee Donner Public Utility District will abandon the existing 60 feet wide easement along the easterly and southeasterly boundaries. This easement area is shown hatched on the attached Exhibit"B" map. It is important that this recording and abandonment be attended to as soon as possible.
