Home My WebLink AboutRES 2009-15 - Board TRUCKEE DONNER Resolution No. 2009 - 15 MAKING NOMINATION TO THE POSITION OF ALTERNATE SPECIAL DISTRICT MEMBER OF THE NEVADA COUNTY LOCAL AGENCY FORMATION COMMISSION WHEREAS, the Board of Directors of the Truckee Donner Public Utility District has received notice of the request for nominations for the Alternate Special District Member position on the Nevada County Local Agency Formation Commission, pursuant to Section 56332 of the Government code; and WHEREAS, the Board of Directors of the Truckee Donner Public Utility District has considered and determined to nominate the individual named below to serve on Nevada County LAFCo as the Alternate Special District Member. NOW, THEREFORE, BE IT RESOLVED, the Board of Directors nominates Jeff Bender for Alternate Special District Member with a term to expire May 6, 2013. The forgoing resolution was duly passed at a regular meeting of the Truckee Donner Public Utility District held on May 20, 2009, by the following roll call. (Mr. Perea was completing the term of Kurt Grundel, who had recently been elected to complete the term of District Naze Beason Member Hank Weston upon the latter's election as County Supervisor, District County Alternate IV.) We are therefore requesting nominations for the next four-year term of the Alan Kiitorn Alternate(non-voting)District Member, which will end May 6, 2013. Public Alternate Commissioners are appointed for four-year terms pursuant to Government Code Ron Perea Section 56334. Terms expire on the first Monday in May of the ending year or Districts Alternate upon the appointment and qualification of a successor. Upon receipt of nominating resolutions and resumes, LAFCo staff will prepare the ballot and send it to each Independent Special District. (Resumes for nominees will be copied and included in the ballot packet.) The ballot may not be photocopied—only the original ballot will be accepted by LAFCo. Only the Chairperson of the Board of Directors or an appointed substitute may complete and sign the ballot. 5. The ballot must be returned to LAFCo no later than the date stated on the ballot. (To make sure every district has an opportunity to consider its vote at a regularly scheduled meeting, we will plan on allowing not less than 35 days for return of ballots.) 6. The votes will be tallied by LAFCo staff in the presence of at least one disinterested third Ply• 7. NOTE: Since the last election of a Special District Member(or Alternate), LAFCo law has been changed to provide for completing an election without a mailed ballot if there is only one nominee. See Government Code Section 56332 (c) (1). 8. Results of the election for the LAFCo Alternate Special District member will be sent to each Special District and each nominee. The attached resolution may be used if your Board so desires. Please note, however, that the choice of method is really up to the Independent Special Districts of Nevada County, not LAFCo. Districts that would prefer to have the Selection Committee meet in person to submit nominations and conduct an election may submit a written request to the LAFCo office. If a majority of the districts sign such a request, that method ,,�. will be used for the next election of a district member or alternate. Code Section 56334, LAFCo Commissioners are appointed for four year terms, unless other arrangements are made by the appointing authority. The expiration date for each term of office is the first Monday in May of the year in which the term expires. City members rotate to the Alternate (non-voting)position annually on the first Monday in May, in the fol- lowing order: Grass Valley, Nevada City, Truckee. Thus in 2010 the Grass Valley member will become the Alternate City Member, in 2011 the Nevada City member, and in 2012 the Truckee member.
