HomeMy WebLinkAboutRES 1996-16 - Board RESOLUTION NO 9616 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DIRECTING THAT COMPETITIVE BIDDING BE DISPENSED WiTH IN CONNECTION WITH THE DISTRICT'S CONSTRUCTION OF UNDERGROUND ELECTRIC LiNES IN CONJUNCTION WITH A JOINT TRENCHING AGREEMENT WITH SOUTHWEST GAS WHEREAS, Southwest Gas Company is currently excavating throughout the District's service area to install its gas lines, and WHEREAS, the District has identified several areas which would be in the District's best interest to integrate its excavating operations with Southwest Gas Company and enter into a joint trench arrangement with Southwest Gas Company, and WHEREAS, the District has determined that integrating its trenching efforts with Southwest Gas Company would not permit competitive bidding because Southwest Gas Company has already contracted with a firm to perform all of the excavation work for the installation of the gas lines in our service area, and r^ WHEREAS, joint trenching is beneficial because it would eliminate the need of removing pavement from the Town of Truckee road system twice which diminishes the detriment impact of excavation on the road system; and WHEREAS,joint trenching is beneficial because it eliminates the need to disrupt the flow of traffic on the major thoroughfares, namely Glenshire drive, Route 267 downtown, and Alder Creek road, twice by coordinating the excavation efforts, and WHEREAS, joint trenching is beneficial because it reduces the noise and other environmental impacts of excavation by only trenching in an area once, rather than twice; and WHEREAS,joint trenching is beneficial to the District's customers because reduces the trenching costs by approximately fifty percent, avoids the waste of public funds competitive bidding would cause, and obtains the best economic result for the public; and WHEREAS, CALTRANS has refused to issue the District a permit to excavate the Truckee River bridge crossing separately from Southwest Gas Company and has, in effect, required the District to trench jointly with Southwest Gas on this project, and WHEREAS, the Schussing, Alder Creek, to Highway 90 North project will require excavating on United States Forest Service land and the United States Forest Service would prefer a single trench because it would disturb the United States Forest Service soil only once and reduces the �— impact on the enjoyment of United States Forest Service land by the public by only excavating that area once, rather than twice; and WHEREAS, the Town of Truckee has indicated that it will not permit overhead electric lines along Glenshire drive on account of that area being deemed a scenic corridor, which means that the District will have to underground its facilities along Glenshire drive; and WHEREAS, areas within the Glenshire Road to Truckee River Bridge project do not permit enough room in the utility easement for the placement of two trenches which therefore necessitates sharing one trench with Southwest Gas Company; and WHEREAS, the Truckee Tahoe Airport District has indicated that it will reimburse the District for some of the joint trenching costs with Southwest Gas Company for under grounding the utilities along Truckee Airport Road to the Truckee Tahoe Airport District, and WHEREAS, the District must purchase conduit for the joint trenching projects, and WHEREAS, the District learned of Southwest Gas Company's excavation schedule only fourteen days before some of the areas considered for joint trenching will be commenced, and WHEREAS, for example, Southwest Gas Company will be trenching along Glenshire drive in the next twelve days, and WHEREAS, the District will not have sufficient time to competitively bid for some of the conduit required for the areas considered for joint trenching due to Southwest Gas Company's excavation schedule, and WHEREAS, various California court decisions, including Graydon v. Pasadena Devewment Agency. 104 Cal.App.3d 631 (1980), hold that if the subject of a contract is such that competitive proposals would be unavailing or would not produce an advantage and the advertisement for competitive bids would thus be undesirable, impractical or impossible, a public agency may dispense with competitive bidding, and WHEREAS, due to the facts set forth above, competitive bidding would be unavailing and would not produce an advantage to the District, and the advertising for competitive bids would not produce an advantage to the District and would be undesirable, and WHEREAS, the District has determined that entering into a joint trenching agreement with Southwest Gas Company is required to integrate the trenching activities of the two entities and obtain the advantages outlined above; and WHEREAS Public Utilities Code Section 20201 generally requires that the District seek competitive bids when engaging in new construction if the cost of materials, supplies and labor exceed$10,000, and NOW, THEREFORE, BE IT RESOLVED that the Board of Directors adopts the above recitals as its findings, and BE I FURTHER RESOLVED by the Board of Directors that for the reasons set forth above, the District finds that competitive bids for excavation in the areas where joint trenching with Southwest Gas Company is necessary, permissible and/or desirable would be unavailing and would not produce an advantage to the District and the advertisement for competitive bids would not produce an advantage to the District and would be undesirable and costly. BE IT FURTHER RESOLVED that the District shall therefore dispense with competitive bidding for the excavation in areas where joint trenching with Southwest Gas Company is necessary, permissible and/or desirable, and to negotiate directly with Southwest Gas Company to enter into a joint trenching agreement. BE IT FURTHER RESOLVED that the District shall therefore dispense with competitive bidding to acquire the necessary conduit for the joint trenching projects where, due to time constraints, competitive bidding is impossible. PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held with the District on the first day of May 1996 by the following roll call vote: AYES: Aguera, Jones, Maass, Sutton and Hemig.
