HomeMy WebLinkAboutRES 1986-04 - Board RESOLUTION NO. 8604 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT APPOINTING WOOD, BROWN, IVEY, MITCHELL AND PETTY SPECIAL COUNSEL TO' ASSIST THE DISTRICT IN FORMATION OF AN ASSESSMENT DISTRICT AT HIRSCHDALB WHEREAS, the water system serving the Village at Hirschdale fails to meet the standards set forth by the State of California; and WHEREAS, the property owners of Hirschdale petitioned the Truckee Donner Public Utility District for annexation into the District and said annexation has been accomplished; and WHEREAS, the District has , on behalf of the Village at Hirschdale, applied for financial assistance to reconstruct the water system at Hirschdale; and WHEREAS, it is the policy of the District that the costs of expansion of the District water system be born by the benefiting property owners; and WHEREAS, the formation of an assessment district is the customary means by which costs of expansion can be properly levied to the benefiting property owners; and WHEREAS , the formation of an assessment district requires the assistance of special counsel versed in the procedures of assessment district formation; and WHEREAS, Wood, Brown, Ivey, Mitchell and Petty is a firm qualified to serve as special counsel and has expressed an interest in assisting the District in formation of an assessment district at Hirschdale; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1 . That it is the intent of the District to form an assessment district at the Village of Hirschdale. 2. That Wood , Brown, Ivey, Mitchell and Petty be hereby appointed special counsel under the terms of their letter dated March 11 , 1986, their fee not to exceed $4,000. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a regular meeting thereof duly called and held in the District on the 17th day of March by the following roll call vote: AYES: Cooley, Corbett , Sutton and Maass.
