HomeMy WebLinkAboutRES 1986-11 - Board RESOLUTION MO. 8611 OF THE TRUCKEE DONNE PUBLIC UTILITY DISTRICT SUPPORTING PROPOSITION 51 WHEREAS, California doctrine of Joint and several liability can impose the entire burden of awards for pain and suffering on one defendant on the basis of ability to pay, rather than on proportion of fault; and WHEREAS, because of this principle, liability insurance rates have increased tremendously; and WHEREAS, Proposition 51 appears on the ballot because of petitions which have been filed; and WHEREAS, passage of Proposition 51 would amend existing law so that each defendant in a lawsuit upon whom a judgment is levied would not have to pay any more than hi:- determined share; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee 9 Donner Public Utility District as follows: 1. That the District endorse and encourage a "yes" vote on Proposition 51. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District at a regular meeting thereof duly called and held in the District an the 5th day of May, 1986 by the folloetag roll call vote: AYES: Cooley, Corbett, Hamilton, Sutton and daass.
